Maloney motioned to approve North Olmsted Assembly of God Church of 3874 Columbia Road their request <br />for variance (1123.12). Which consists of expanding existing gravel parking area and that the following <br />variances be granted: <br />1) A variance not to install a concrete or bituminous concrete pavement parking lot or provide drainage or <br />curbing for the same as required by the zoning code, (1161.11). <br />2) A 15 foot variance for sideyard setback (code requires 20ft setback, applicant shows Sft) (1118.02 (2 C). <br />3) A 15 foot variance for rear yard setback (code requires 20ft setback, applicant shows Sft) (1118.02 (2 C). <br />Which is in violation of Ord. 90-125 sections, (1161.11) and (1118.02 (2 C). The motion was seconded by J. <br />Konold and unanimously approved. Variances Granted. <br />Mr. Gareau indicated that he would like to review a few of the issues regarding the Timberview home proposal. <br />He indicated that a variance was not needed for the width of the lot. Therefore the 22ft variance should not be <br />before this board. There is a provision in the zoning code, which addresses the use of non-conforming lots. A <br />non-conformixig lot can be used, provided that all the other zoning code requirements are met. If the 22 foot <br />variance was denied the board would be indicating the lot could not be used. That is not the purpose of the <br />zoning code. This is an issue that has come up in the past. He further indicated that the second variance request <br />(A 4,150 square foot variance for lot area) also be removed froin the applicants request as it is also addressed in <br />the zoning code tmder use of non confornung lots. Mr. Gareau indicated that the only variances the Board of <br />Zoning Appeals board would need to address regarding Timberview Homes was issues 3, 4, 5, and 6 only. <br />12. Timberview Homes (Curt Dtullap); 6123 Decker Road: <br />Request for variance (1123.12). Proposal consists of building a home. <br />The following variances are requested: . <br />1) A 22 foot variance for lot width (B-district lot to be 70ft wide, applicant shows 48ft wide) (1135.05 A). <br />2) A 4,150 square foot variance for lot area (B-district lot to be 10,850sq ft, applicant shows 6,700sq ft) <br />(1135.05 A. <br />3) An 8 foot variance for front setback (code requires SOft applicant shows 42ft) (1135.06 A). <br />4) A 2 foot variance for north side yard setback (Where they would only have Sft and 7 ft would be required to <br />have 15ft between adjacent dwellings) (1135.07 A). <br />5) A 9 foot variance for side yard setback of a comer lot (code requires 25ft applicant shows 9ft) (1135.06 B). <br />6) A 166 square foot variance for minimum livable first floor area (code requires .850sq ft, applicant shows <br />684sq ft, second floor shows 928sq ft) (1135.03 B). <br />Which is in violation of Ord. 90-125 sections, (1135.03 B), (1135.05 A), (1135.06 B) and (1135.07 A). <br />Note: Lot coverage is only at 16%. - <br />Chairman Gomersall called all interested parties forward and reviewed the variances being requested. Mr. <br />Dunlap, the Builder, Mr. Khicar, the owner of the property, and Mrs. Phillips, a concerned neighbor, came <br />forward. Mr. Gomersall commented that the first two write-ups are not needed so only variance requests 3, 4, 5, <br />and 6, would be addressed. Mr. Dunlap indicated that the lot is 49.91 feet wide by 140 feet deep. He showed a <br />picture of a home on Porter Road, which would be the same style as the proposed home for Decker Road. It will <br />be a 3 bedroom 1 1/2 bath with a full basement. Mr. Gomersall asked if Mr. Klucar would be living in the <br />house or selling the lot. Mr. Klucar indicated that he was in the process of selling the lot to Timberview Homes. <br />Mr. Dunlap indicated that the sale of the lot is contingent upon the vanances being granted. Mrs. Phillips <br />indicated that she was concerned about the number of trees that would be removed from the lot and that there <br />was presently a traffic problem. Adding this small of a driveway would only add parking problems. The lot is a <br />corner lot and if the new owners have company they will have to park in the street. Mr. Dunlap indicated that <br />the driveway would be a full size driveway. Mr. Koberna commented that he agreed with Mrs. Phillips that <br />because of the school, which is located near Decker Road there, is an existing traffic problem. Mrs. Phillips <br />conunented that, there has been concerns in the City about the amowit of trees that are being removed and she is <br />6
