. <br />concerned, as this was the last lot left of Decker Road. Mr. Gomersall indicated that the applicant could not be <br />denied his request on the basis of trees being removed. Mr. Gomersall further commented that he had noticed <br />that the neighbor stacks his firewood on the proposed lot. Mr. Dunlap indicated that the trees in the front would <br />be removed to build the house but he would keep as many trees in the back of the lot as he could. Mrs. Phillips <br />uidicated that she had once owned the land, and she would like to purchase the property back. Mr. Maloney <br />indicated that there is presently a sidewalk on Southern Avenue, and no sidewalk on the north side of Southern <br />Avemie. There is also 2 utility poles on the site that would need to be addressed. Mr. Dunlap indicated that he <br />was speaking with the Power Company about moving the poles. Mr. Gareau indicated that the if the variances <br />are granted the board would have to assume that the owner has the responsibility to take care of the fire hydrant <br />and the utilities. Mr. Rymarczyk indicated that the Engineering department would have to address the issue of a <br />sidewalk. No further comments were made. <br />W. Kremzar motioned to approve Timberview Homes (Curt Dunlap) of 6123 Decker Road his request for <br />variance (1123.12). Which consists of building a home and that the following variances be granted: <br />1) An 8 foot variance for front setback (code requires 5 Oft applicant shows 42ft) (1135.06 A). <br />2) A 2 foot variance for north side yard setback (Where they would only have Sft and 7 ft would be required to <br />have 15ft between adjacent dwellings) (1135.07 A). <br />3) A 9 foot variance for side yard setback of a corner lot (code requires 25ft applicant shows 9ft) (1135.06 B). <br />4) A 166 square foot variance for minimum livable first floor area (code requires 850sq ft, applicant shows <br />634sq ft, second floor shows 928sq ft) (1135.03 B). <br />Which is in violation of Ord. 90-125 sections, (1135.03 B), (1135.05 A), (1135.06 B) and (1135.07 A). <br />Note: Lot coverage is only at 16%. The motion was seconded by T. Koberna and una.nunously approved. <br />Variances Granted. <br />13. Donato's Pizza26180 Lorain Road: „ <br />Request for variance (1123.12). Proposal consists of additional seating. <br />The following variance is required: <br />1) A variance for 9 additional seats for a total of 63 seats. <br />Which is in violation of Ord. 90-125 section, (1161.5 R). <br />Note: Code allows 2 seats for each parking space. Applicants have 27 spaces which allows them 54 seats. The <br />request for 9 additional seats is a 25% reduction from the original 12 that was denied on June 3, 1999. <br />Chairman Gomersall called all interested parties forward and reviewed the variance being requested. Mr. Tyson <br />owner of Donato's, and Mr. Nowak a concern neighbor came forward. Mr. Gomersall reviewed that the request <br />had been amended to 9 seats from the applicant's first request of 12 seats which was denied. Mr. Gomersall <br />indicated that the seats were put in place without approval. Mr. Tyson indicated that the additional seats were <br />not on purpose and that he was not aware of the mistake until the final inspection was made. Mr. Nowak - <br />uidicated that he thought it was parking the first time he came to the meeting. He just wanted to find out how the <br />proposal would affect the neighbors. Mr. Gomersall indicated that the number of seats was not as bad as he <br />thought it was when the proposal first came before the board. No further comments were made. <br />J. Konold motioned to approve Donato's Pizza of 26150 Lorain Road their request for variance (1123.12). <br />Which consists of additional seating and that the folloNving variances be granted: <br />1) A variance for 9 additional seats for a total of 63 seats. <br />Which is in violation of Ord. 90-125 section, (1161.5 R). <br />Note: Code allows 2 seats for each parking space. Applicants have 27 spaces which allows them 54 seats. The <br />request for 9 additional seats is a 25% reduction from the original 12 that was denied on June 3, 1999.
