Aileen Novak- 3935 Eleanor Dr. <br />Request for variance 1123.12. The proposal consists of adding a family room to existing <br />home. The following variances are requested: <br />1. A special permit to add to a non-conforming building (1165.02). <br />2. A variance to enlarge a non-conforming dwelling (1165.02 (b)(2). <br />3. A 20 foot rear yard variance (code requires 50 feet, applicant shows 30 feet), <br />(1135.08a). <br />Which is in violation of Ord. 90-125 sections 1165.02 and 1135.08a. <br />Vice Chairman Maloney called all interested parties forward and reviewed the variances <br />requested. The oath was administered to Mr. Burke, the contractor who came forward to <br />review the request. Mr. Burke reviewed that there would be a four-season addition added <br />to the existing home. No further comments were made. <br />J. The proposal consists of a fence in neighbor's front <br />setback. The following variances are required: <br />1. A variance to install 54.6 feet of 100% closed face fence, (code requires 50% open <br />applicant shows 100% closed), section (1135.02 F 1). <br />2. A 42 inch height variance for 54.6 feet of fence which is in the abutting neighbors front <br />setback, (code permits 30" applicant shows 72"), section (1135.02 F 2). The oath was administered to Mr. & Nlrs. Castrigano the owners who came <br />forward to review their request. Mrs. Castrigano indicated that with the way the house is <br />set on the lot the fence would end at the porch if it were built to code. They would be <br />willing to have the height of the fence at 5.6 feet. Mr. Koberna asked how the fence <br />would be designed at the top. Mrs. Castrigano indicated that the fence would be square at <br />the top. W. Rymarczyk indieated that if the fence encloses the power poles the city <br />would remove the fence and the applicants would be charged for the work. Mr. Maloney <br />suggested angling the fence around the pole to avoid future trouble. Mr. Koberna <br />indicated that the board would prefer the fence to be 5.6 feet in height.
