There is some merit to the proposal but the <br />effect on the residential area in this location is a concern. Mr. Hreha commented that he felt the <br />proposal should be tabled and Mr. Wanamaker should bring the owners of Teligent, and experts <br />on the antennas. Mr. Koeth agreed with 1VIr. Hreha and requested that the owners of Teligent be <br />present to address questions about the R F waves and exactly how long, wide, what.happens if it <br />is deflected or out of alignment? What is the R F waves ranges? They will also need to be <br />prepared to answer the resident's questions. Mr. Allan indicated that he strongly agreed with Mr. <br />Asseffs comments. Mr. Dubelko commented that the Planning Commission has addressed issues <br />regarding the telecommunication antennas over the last few years now. It is important for the <br />residents as well as the Planning Commission to understand that under the federal <br />telecommunications act of 1996 local municipal corporations have limited authority to regulate <br />placement. He recommends that the issue be sent back to the Law department`to look at this <br />issue applied to this type of technology. Generally speaking the City can not take into account the <br />health issues in making decisions on positioning these antennas, that is federal law which preempts <br />us. The City is limited to site issues, Teligent has been before this board before and it is a <br />different technology and kind of falls between the cracks. The Law Department should be asked <br />to look into this issue to look at the basic issue as to whether or not the Commission has any <br />authority to make recommendations based on health concerns. Mr. Spalding questioned if he <br />understood the Assistant Law Director to be saying the Commission could not consider health <br />issues when addressing these antennas. Mr. Dubelko indicated that that is what needed to be <br />looked into. Mr. Holly suggested that he believed that the federal code covered general <br />population usage and this is singular use for these two buildings only, no other buildings can <br />access the antennas it is a single use. Mr. Dubelko commented that ,the he would be looking <br />further into that issue and the City hired an expert whom he will address his questions to <br />regarding this type of antenna. <br />R. Tallon motioned to table Technology Park 1& II (Teligent, Inc.) which consists of installing a <br />24-inch microwave antenna on a two- (2) story building for use with fixed wireless telephone <br />technology. The Planning Commission will send the issue back to the Law Department to look <br />into the technology with respect to being so close to residents. There should be an R F expert <br />with the applicant the next time he returns so that they can answer the boards and residents <br />questions. In regards to questions pertaining to leakage, what means of testing is done on site to <br />make sure the beam stays in alignment. Is there any type of screening in today's technology to <br />screen the R F waves from leaving the site. Finally are there any alarms that will alert someone if <br />the beam is out of alignment. If there is some type of equipment that will be used to test the <br />equipment annually, if not the board will request the company will annually do, maintenance <br />checks on the equipment as part of the approval. The motion was seconded by, K. O'Rourke and <br />unanimously approved. Motion Caa-ried. Note: Mr. Wanamaker indicated that he wanted on <br />record that their company had been before the commission before and had three other antennas on <br />other buildings in the City. Mr. Tallon sited the buildings the other antennas were placed on and <br />indicated that none of the buildings were two story they where no lower then 4 stories high <br />therefore, quite different from the current proposal. <br />2. Technology Park II (Teli ent Inc.) 25209-25249 Countrv Club Blvd.: <br />Proposal consists of installing a 24-inch microwave antenna on a two- (2) story building for use <br />with fixed wireless telephone technology.
