<br />r' <br />abuts Lorain road will house a 4,500 square foot building. Mr. Fisher submitted new plans that <br />had a detailed landscaped plan to each of the commissioners. Mrs. O'Rourke questioned what <br />the front building would house. Mr. Fisher indicated that the building will meet all the <br />requirements of the city Codes and it is within the 25 % building coverage. The Code requires <br />352 parking spaces and they have 356 parking spaces. To answer Mrs. O'Rourke's question <br />there is no users at this time for either addition. The tenants will be family type users <br />compatible with Babies R Us. Mr. Hreha suggested that the owners pay closer attention to their <br />back yard along the fence. When he was at the site earlier in the day there was trash along the <br />fence and a few of the fence areas need to be addressed. Mr. Fisher indicated that the new <br />building would be on the east side of the existing building and Mr. Hough takes a lot of pride in <br />the property that he is involved with and will address it quickly. Mr. Spalding indicated that he <br />too was at the site and when Babies are us came before this board for approval one of the <br />concerns of the neighbors was the condition of the fence itself. Some of the boards have been <br />replaced but an entire section of fence was laying against a tree. At the west side of the site a <br />portion of the fence was missing. The fence did not impress him at all and a new fence is in <br />order. Mr. Spalding is not sure who planted the plants but some of them have died or just not, <br />there as there are big gaps between the plants. The fence is very weak and if he was one of the <br />neighbors, he would be very upset with the condition of the fence. Mr. Fisher suggested that <br />the fence was board on board and erected by Best Products. The plants have obviously matured <br />and for all accounts appropriate in terms of screening, that separates the commercial sites from <br />the abutting residential neighborhood. Obviously, they will repair the fence where it needs it. <br />The amount of space between the ground and the boards should be addressed. There will be <br />additional plants as indicated on the plans. Mr. Spalding strongly recommended replacing the <br />entire fence. Mr. Ports indicated that they would replace the damaged portions of the fence, but <br />they would have to study the quality of landscaping on the resident's side of the fence before the <br />fence is replaced. Past practice has shown us replacing the entire fence can damage existing <br />landscaping. They will take care of the leaning fences. Mr. Spalding again recommended a new <br />fence be put in place. The last time Babies R Us was before, this board the fence was a <br />condition of the approval, and it is still in bad shape. Mr. Tallon believed that the property <br />directly behind the fence belonged to developers diversified. Mr. Ports questioned if the board <br />wanted the fence replaced with another board on board fence. Mr. Tallon indicated yes and <br />asked for additional landscaping, as the land right behind the fence is their property. Mr. Hough <br />suggested that children were destroying the fence and using the area as a cut through to the <br />mall. Mr. Spalding remarked that the fence is too old and needs to be replaced. Mr. Covell <br />from Leanders Lane indicated that he lived behind the Babies R Us store. When he moved in <br />three years ago the fence was down and Best products were gone. He fixed the section of fence <br />that was along his property. The fence has been taken apart by the high school kids, for a cut <br />through to the Mall. Replacing the fence is good and landscaping is good. He is more <br />concerned about the BFI trucks picking up the dumpster at 4:30am in the morning. His two (2) <br />and four (4) year old children were constantly being woken up in the middle of the night. The <br />sub-contractors would then start work at the crack of dawn and work until after 9:30pm. The <br />children were awakened to jackhammering at 7:00am. Will there be someone for of the <br />residents to-talk to when BFI is there at 4:00am in the morning. He is more concerned with the <br />construction noise at dawn and the late night noises than the fence. Mr. Conway indicated that <br />there were specific hours that work can be done. The workers have to have a special permit to <br />8
