proposal was heard at the May 23, 2000 Planning Commission meeting and withdrawn by <br />the applicant. Additional data requested included. <br />Chairman Tallon called all interested parties forward to review the proposal. Mr. Lydon, <br />from Zaremba Manageinent, came forward to review the proposal. He indicated that a <br />question arose at the previous meeting of May 23, 2000 that if the lot split were approved, <br />at some time in the future the property could be sold and request access to the property. <br />Mr. Lydon indicated that based on this development, the applicants would be willing to <br />deed the parcel to the City of North Olmsted and allow the City to impose deed restrictions <br />on the property subject to their intended use. Then in turn, deed the property back to the <br />applicants with those deed restrictions in place. He indicated that in the future, the plan <br />could not change. The property could not be sold to anyone else with the ability to develop <br />the parcel because all the access would be through the remaining parcels in Fairview. Mr. <br />Lydon indicated that the idea was discussed with the Law Department. He indicated that <br />they ask that a portion of the property be used for paved parking area with the remainder <br />left to green space of which the applicant would provide architectural landscape plan to be <br />submitted when the permit for parking area is applied for. Mr. Dubelko indicated that if <br />Planning Commission favors this proposal, the Law Dlepartment is in agreement. He <br />indicated that this issue came up recently with Water Tower Plaza and what is the most <br />effective to enclose restrictive covenants on property. He indicated that the most effective, <br />would be deeded from the owner to the city then the city would deed it back in the future. <br />Mr. Dubelko indicated that the decision is up to the Planning Commission as to what the <br />restrictions would be. Mrs. O'Rourke questioned if restrictions would be maintenance, etc. <br />Mr. Dubelko indicated subject to the use of the property. Mr. Tallon questioned if the <br />restrictions should be done tonight. Mr. Dubelko indicated that the Planning Commission <br />should have an idea. He indicated that there should be a percentage used for parking and <br />for a percentage for green space, it should be a simple solution of what percentages they <br />would be. Mr. Lydon indicated that 39% is parking and the balance is green space. He <br />indicated that if a 60/40 split were to be proposed and agreed upon, he still needs to come <br />back before Planning Commission, Engineering, and Building with final plans. Mr. Lydon <br />indicated that the setbacks were set to comply with the existing parking setbacks within <br />general off'ice district of North Olmsted. He indicated that they anticipate moving most of <br />the topsoil to create substantially mounding, which would further screen the property. Mr. <br />Lydon indicated that the parcel, which is 160 feet by 300 feet, is not big enough for <br />anything else. Mr. Tallon indicated he does not have a problem with the 60/40 split, with <br />the substantial buffering from Brookpark Road. Mr. Dubelko questioned if there was a <br />long-standing proposal for the development of the North Olmsted portion at Board of <br />Zoning and Development that is pending. Mr. I,ydon indicated that the first time they came <br />before the City of North Olmsted was for a water retention basin. 1V1r. Dubelko questioned <br />if they had gone before Planning Commission. Mr. Lydon indicated that they had gone <br />before Planning Commission, but the proposal had been withdrawn due to the fact that the <br />City did not want an above ground retention basin. He indicated that water retention <br />requirements are much stricter in North Olmsted than in Fairview. Mr. Tallon questioned <br />where the basin would flow. Mr. Lydon indicated that it would flow downward to the <br />Metro parks. He indicated that they have been approved for access from ODOT.
