Rymarczyk indicated that Malorey Construction said <br />that they were working directly for her on her payroll, because they are not even registered <br />in the City of North Olmsted to do any work. Ms. Boger replied that in this particular <br />case, her company paid for all the material because Malorey didn't want to do that. They <br />worked directly for her at that point. Mr. Rymarczyk questioned if they were on her <br />company's payroll. Ms. Boger indicated that her company paid them, but they are not on <br />an everyday basis on her payroll. Mr. Rymarczyk questioned if they were on her payroll on <br />this particular job. Ms. Boger indicated that they were given a draw. Mr. Klesta <br />questioned if they were working under her license to be in this area. Ms. Boger replied yes. <br />Mr. Klesta indicated that if she brought a subcontractor in, then they would have to be <br />licensed in the City of IVorth Olmsted. They were not licensed in the City of North <br />Olmsted, where as you were, so they worked under your license, and you are responsible <br />for everything they have done. Ms. Boger indicated that she was not trying to get around <br />anything. Mr. Engolia suggested that the board was just trying to deternune who the <br />contractor and the subcontractor was. You are the contractor in this case and they are not <br />a subcontractor. Ms. Boger indicated that as far as she is concerned they are <br />subcontractors because they don't work for her on every job. Mr. Engolia commented that <br />they are just asking about this one particular job. Ms. Boger indicated that on this job they <br />worked for her. Mr. Engolia replied that was all they wanted to know. Mr. Puzzitiello <br />questioned if they have insurance. Ms. Boger replied that their insurance will not cover <br />this, they will have to be financially responsible for this. They have liability insurance and <br />when they came and said that the earth kind of moved, they called it an earth slide and will <br />not cover it. Mr. Puzzitiello questioned what she meant when she said the earth moved. <br />Mr. Klesta indicated that it moved because of the way it was back filled. Ms. Boger <br />indicated that is just what the insurance company said. Mr. Engolia questioned if the <br />owners had a mortgage on this property. Mrs. Busony replied that they got a construction <br />loan. Mr. Engolia questioned if they were going to give an inspection before they give <br />them their first draw. Mrs. Busony replied yes. Nk. Engolia questioned if they have done <br />this. Mrs. Busony replied that they have not done anytlung. Mr. Engolia replied that <br />sooner or later they are going to have to ask for it and they will not give you a draw under <br />these conditions. Ms. Boger indicated that they would as long as everything is done <br />according to the structural engineer. Mr. Engolia responded that if they were to come out <br />, today, they wouldn't give an inspection. Ms. Boger suggested that she wasn't saying that <br />they should. She intends to follow Mr. Wolk's recommendation and get a third party in, <br />independent of her company, to take care of this. Mr. Engolia commented that he knows <br />she is nervous, and he is not looking to give her a bad time, but the things that happened on <br />this site are not very nice. The board has to protect the City and the people of the City of <br />North Olmsted. They can not allow things like this to happen. These people are going to <br />- be residents here and they have to worry about them. Ms. Boger agreed. Mr. Engolia re- <br />iterated that they are not trying to be nasty, it is just a nasty situation. Mr. Puzzitiello <br />questioned if they lined anybody up to fix this. Mrs. Busony indicated that she had talked <br />with J&K Excavating, who did the original hole, and he can actually clear the site and do <br />all the connection afterward. He can also do the stone and backfill. She also talked with <br />Justin Gorsica, a bricklayer. Mr. Engolia questioned if any of these people have seen the <br />letter from the engineer. Mrs. Busony replied no, they just received that letter themselves <br />1)
