<br />shows 32.5 sq. ft.), section (1163.24-C). <br />Which is in violation of Ord. 90-125 section (1163.24 C). T. Kelly seconded the motion and was <br />unanimously approved. Variance Granted 9/6/01. <br />10. Michael Simonson; 24716 Antler Dr. <br />Request for variance (1123.12). The proposal consists of buildina a shed. <br />The following variances are requested: <br />1) A 3 ft. variance for side yard setback (property line) (code requires S ft., applicant shows 2 ft.), <br />section (1135.02 D-4). <br />2) A 2ft. 6 inch variance for rear property line setback (code requires 10 ft., applicant shows 7ft. 6 <br />inches), section (113 5.02 D-4). <br />Which is in violation of Ord. 90-125 section, 1135.02 D-4. Note: Started without permit. <br />Chairman Maloney called all interested parties forward to review the request. The oath was administered <br />to Michael Simonson, the owner, who came forward to review the request. Mr. Simonson indicated that <br />he put the shed in the left part of his backyard. There was an existing shed that was cutting through the <br />roots of a tree, so he took the shed down. He took the liberty to ask all of his neighbors if they had <br />problems with this, and showed the board signatures of neighbors. Mr. Kremzar questioned if this had <br />been started already. Mr. Simonson replied that his father had started pouring the foundation, not <br />knowing that he did not have the permit. Nothing has been built, they just started to lay the concrete <br />foundation. Mr. Kremzar questioned if he was outside the drainage swail. Mr. Simonson replied yes. <br />Mr. Kremzar indicated that he would be 2 feet from the property on the side and 7 ft. from the back. W. <br />Simonson replied correct. 1V1r. Kremzar questioned the water runoff. Nlr. Simonson replied that it will <br />run off the side. The neighbor Nlrs. Anne Cook signed his letter stating that it is O.K. where it is placed. <br />Mr. IVlaloney commented that he had a problem with the two feet from the side primarily for maintenance <br />purposes. That doesn't give him much room to get in there. Mr. Siinonson commented that he tried to <br />keep it as far away from the fence as possible, but there is a tree there which forced him to place it in <br />between the two. It is about two feet away from the tree. Mr. Kelly indicated that the tree is going to <br />get bijger down the line. Mr. Simonson replied that the tree is about 50 years old and is pretty big. Mr. <br />Maloney called for a motion. <br />W. Kremzar motioned to grant Michael Simonson of 24716 Antler Dr. his request for variance 1123.12. <br />Which consists of a shed and that the following variances be granted: <br />1) A 3 ft. variance for side yard setback (property Iine) (code requires 5 ft., applicant shows 2 ft.), <br />section (1135.02 D-4). <br />2) A 2ft. 6 inch variance for rear property line setback (code requires 10 ft., applicant shows 7ft. 6 <br />inches), section (1135.02 D-4). <br />Which is in violation of Ord. 90-125 section, 1135.02.D-4. The <br />followino, variance is requested: <br />1) A 1 ft. 3 inch variance for accessory structure height (code permits 15 feet, applicant shows 16 feet 3 <br />inches), section (1135.02 D-3). <br />Which is in violation of Ord. 90-125 section, 1135.02 D-3. <br />Chairman Maloney called all interested parties forward to review the request.
