Ms. Schulz said what the board is presenting seems to make more sense. 1VIr. <br />Davison said flipping it 180 degrees would not work because the building will be over the property line. <br />He can see maybe flipping it 90 degrees and making it work. Mr. Yager said he would like them to re- <br />evaluate the site. He is uncomfortable and he would not accept the proposal as submitted. There are a <br />few things they can do. They can ask for a vote. He indicated they are a board of recommendation so <br />if they don't like the vote, they can go to someone else and they can overrule. Most of the time, the <br />other boards listen to the Architectural Review Board. The board can ask them to go back and re- <br />evaluate the site and come back. They can offer to table the proposal and have the applicant come <br />back, or they can ask for a vote to use in whatever manner they want. He said those are the options. He <br />added that the applicants have heard enough from the board and there has not been much wavering. <br />They can now choose the direction they want to go. Mr. Davison said they already got the variances <br />and he doesn't see how they can move it the way the board is recommending. They are restricted by the <br />site. If they put the entrance on Dover they would have no parking. He said they can make it look like <br />the front. Mr. Zergott asked if it is representative of the kind of building Mr. Davison would want to <br />work in as far as landscaping. He certainly would have presented a more beautiful landscape design. <br />Mr. Yager asked if they would be selling the tenants the property. Mr. Khouri said they are leasing the <br />property. Mr. Yager said the property could then become a part of the bigger property, which is Water <br />Tower Square. He said they could get a lot consolidation and they would not have nearly the <br />restrictions they feel they have now. Mr. Khouri said they would have a problem with parking. Mr. <br />Yager said the difference they are talking about is maybe 8 spaces in a lot that holds 1200. He said the <br />make-or-break zone is 8 spaces. Mr. Khouri said that is code. Mr. Yager said in all the times he has <br />been in the plaza he has never seen anyone park over in the section in question. He said they are <br />talking about the applicants being crimped by sornething that is more mystique than reality. The <br />property line is not their property line; it is your property line. He added the city is already perceiving <br />the two entities together otherwise they would not be able to do half the things they are doing here. Mr. <br />Khouri said Water Tower Square gave a company an easement to encroach on the land. Mr. Yager said <br />they would not have gotten a variance if they did not already own a certain portion of land. Mr. Zergott <br />said they should table it or deny it. He pointed out the board does not have a meeting in August. He <br />askecl if tlie board would be wilting to meet if the appiicants came back with somethinb substantial. <br />Mr. Yager said he can meet with them any time. He asked the applicant if they would rather the board <br />vote on it, or table the proposal. He inentioned they could have a special meeting just to look at their <br />proposal. He mentioned they could fax material to his office to expedite matters. The applicants went <br />into the hall to discuss the options. The board members discussed the location of the trash enclosures. <br />Mr. Davison came back and announced they would prefer to table the proposal. Mr. Zergott pointed <br />out the board discussed the duinpster area. Mr. Khouri said they will inove it. Mr. Yager said he <br />believes they can flip or rotate the building as the owner of both properties. The minutes that he <br />reviewed regarding the zoning code show him that the city already perceives the two together. So, they <br />have the flexibility of at least making the effort to show the board that it can't work unless it is done as <br />originally proposed. Mr. Khouri said they will need to talk with the tenants. Mr. Yager said they don't <br />want to lose the tenant on the site. Mr. Khouri pointed out they could lose him/the tenant on Lauren <br />Hill, the lease is up there. It is a North Olmsted tenant and they want to keep him here. Mrs. Nader <br />said if they are able to flip it, they will have a much more attractive frontage on Dover Center. As an <br />owner they will have a better building. If a tenant moves out or they look to sell, they will have a much <br />better building. Mr. Khouri said they have a 20-year lease with the tenant and they don't want to loose <br />it. Mr. Yager said they can work through the tenant and the owner, and he will work through the city to <br />arrange a meeting. Mr. Conway commented that if they do not decide on a date for the meeting now, <br />they will have to consider that a week is required for legal notices. Mr. Khouri wondered if the tenant <br />decides he doesn't want to face Dover, would they be abie to put in windows and put up a canopy. Mr. <br />Zergott said that nowhere in North Olmsted can they allow landscaping to blacktop without planting <br />around the building. Mr. Khouri said the landscaping is easy but the tenant is adamant about facing <br />5
