J. Konold made a motion to grant Gregory & Vickie Douzos, 5776 McKenzie Rd., their request for <br />variance (1123.12) which consists of erecting a pole barn for storage and that the following variance be <br />granted as amended: <br />1. A 664 square foot variance for an accessory storage building larger than code permits, (code <br />perinits 200 sq.', applicant shows 864 sq.') section (1135.02 D 1). <br />Note: Existing 12 x12 storage shed to be removed. <br />Which is in violation of Ord. 90-125 section (1135.02 (D1). The motion was seconded by W. <br />Kremzar. Roll call on the motion: J. Konold-Yes, W. Kremzar-Yes, J. Maloney-Yes, N. Sergi- <br />Abstain. 1Vlotion carried. Variance granted as amendeci. <br />3). Jeffrev & Rebecca Revnolds; 5401 Burns Rd.: WRD 3 <br />Request for variance (1123.12). The proposal consists of adding a front porch. <br />The following variances are requested: <br />1. A special permit to add to a non-conforming building (1165.02). Existing house is 22 feet from <br />right of way, code calls for 50'. (1135.06 A). <br />2. A 34 foot variance for front setback of a residence, (code requires 50', applicant shows 16). <br />Which is in violation of Ord. 90-125 section (1135.06 A). <br />Chairman Maloney called all interested parties forward to review the request. Mrs. Reynolds came <br />forward and was sworn in. She explained they currently have 3 stairs going up to the house now. She <br />has young children who have fallen down the steps. Her mother has Parkinson's and so the steps are <br />dangerous for her as well. They would like a small 5x6 porch. The reverse gable is due to water <br />splashing up on the wood and it leaks into the house. Mr. Oley, a neighbor, came forward to be sworn <br />in and address the proposal. He read notes he has taken on the neighbor's expansion. They have done <br />a lot of work on their property. They put an addition on the rear of the house. The following year <br />there was a request for a variance to build a garage. He attended that meeting and agreed to approve <br />construction of the garage. The extension on the house and the oversized garage are large and <br />imposing structures. Mr. Reynolds also installed a chain link fence around the rear of the property. <br />The surveyor put several wooden peg markers along the property line. There was a 2 inch difference <br />between those markers and the ones he had put in some years earlier. He had no problem with Mr. <br />Reynolds using a surveyor at this point. Mr. Oley said in the following years he has experienced water <br />backing up onto his property. He addressed this with the Reynolds and the city and corrections were <br />made. The drainage has improved. He has no knowledge about the proposed construction and has <br />potential concerns because of the repeated drainage problems. There are 2 other concerns that need to <br />be reconciled before moving on with additional construction next to his property. His yellow plastic <br />peg and Mr. Reynolds's wooden peg placed by the surveyor have been removed. The boundary <br />markers moved north a couple of inches and are marked with a stick, which has since disappeared and <br />been replaced by a small piece of inetal pipe. He is not asking for his boundary to be moved back. He <br />wants it reviewed for correctness with the Reynolds'. He said toward the south and east end of his <br />property there is a short wooden double fence on the Reynolds property perhaps for landscaping <br />purposes. It has collapsed over time and pushed the chain link fence out at the bottom causing it to jet <br />out a couple of inches over the boundary line. This makes it difficult for him when he mows the lawn. <br />These are minor concerns that should be worked out between neighbors. He has a concern about the <br />impact additional construction would have on visibility at the front of the house. There are several <br />houses including his home that sit close to the street. He said Burns Rd. is heavily traveled and at this <br />point he has no knowledge about the proposed addition other than the notice he received. He will not <br />agree to make an approval to proceed with this without some further review with Mrs. Reynolds. Mr. <br />Conway suggested showing Mr. Oley the plans. Mrs. Reynolds said the properties on either side of her <br />have porches that come out several feet more than her property. She said even with the proposed <br />addition the other porches are further out so there will be no obstruction in any way. Mr. Oley said it <br />is ok with him. <br />3
