Chairman Maloney called all interested parties forward to review the request. Mr. & Mrs. Criss; the <br />owners, came forward to be sworn in and address their request. Mr. Criss indicated that they would <br />like to place three sections of fence on their lot for privacy. They live on a corner lot and each of <br />their neighbors are 10-feet away from their home. Mr. Kremzar indicated that the home was close to <br />the abutting neighbors. He questioned how high the fence would be. Mr. Criss indicated that the <br />fence comes in 6-foot sections and he will cut the sections to a 5-foot height. <br />J. Maloney motioned to grant Charles and Sharon Criss of 25259 Chase Drive their request for <br />variance (1123.12), which consists of a 5-foot high privacy fence and that the following variances are <br />granted: , <br />1. A 12 foot variance for a fence less than 50% open and higher than 30 inches in front setback (code <br />permits 0, applicant shows 12 ft.). <br />2. A 30 inch variance for a fence higher than 30 inches located 12 ft. in front setback (code permits <br />30 inches, applicant shows 5 ft.). <br />3. A variance for a fence less than 50% open located 12 ft. in front setback (code permits 50% open, <br />applicant shows 0% open). <br />Note: Proposed fence is a 5-ft. high board on board privacy fence. Which is in violation of Ord. 90- <br />125 section (1135.02 (fl(1)). The motion was seconded by J. Maloney and unanimously approved. <br />Variances Granted. <br />10. John Burvis- 5162 Andrus Ave- (WRI)-4) <br />Request for variance (1123.12). The proposal consists of a new garage. <br />The following variances are requested: <br />1. A 416 square foot variance for total square feet of accessory structures in rear yard (code permits <br />600 square feet, applicant shows 1016 square feet), section (1135.02 (d)(2)). <br />2. A 6 foot variance for rear property line setback (code requires 10 ft., applicant shows 4 ft.), <br />section (1135.02 (c)(2)). <br />3. An 8-foot variance for height of a detached garage (code permits 15 ft., applicant shows 23 ft.), <br />section (1135.02 (c)(1)). <br />4. A 2-foot variance for side yard setback, (code requires 5 feet applicant shows 3 foot. Mr. Burvis, the owner, <br />came forward to be sworn in and address his request Mr. Burvis indicated that the existing garage is <br />too small. The garage cannot house a car and has not been used for some time. Mr. Kremzar <br />indicated that the new garage would need to have downspouts. Mr. Maloney commented that <br />downspouts are required to maintain water on your own property. Mr. Burvis indicated that the pitch <br />of the garage is to match the pitch of the home: Mr. Kremzar questioned if a 24' x 28' garage is <br />needed. Mr. Burvis believes that he needs the size he is requesting. Mr. Kremzar questioned if there <br />were any easements on the lot. Mr. Burvis suggested that there were no electrical easements. Mr. <br />Kelly indicated that code permits 600 square feet and Mr. Burvis wants 1016 square feet. Mr. Kelly <br />and Mr. Kremzar are concerned about the size of the garage. Mr. Burvis questioned what size the <br />board would allow him. Most of the existing garages are 24' x 24' throughout the neighborhood. <br />Mr. Kelly suggested having the depth of the garage 26-feet instead of 28-feet. Mr. Burvis indicated <br />that he would agree to 24' x 26'. <br />J.
