?,• <br />rear of the fence angled. Mr. Rymarc2yk suggested placing the fence 7-feet in from the sidewalk <br />instead of S-feet. Mr. 5cullin reiterated that the 6-foot bushes never caused a problem and he did <br />not feel a fence placed closer to the house would cause problems. Mrs. Sergi questioned if the <br />applicants would be willing to angle the fence starting at the pine tree. Mr. Scullin felt that if the <br />board required the fence to be angled he would need to move the fence closer to the sidewalk. <br />Mr. Rymarczyk informed the applicant that code required a fence no highei then 30-inch and 50% <br />opens face. Mr. Kremzar is concerned for the children and wants the fence tapered from the <br />southwest corner in 20-feet. The tapered fence is only to be 4-foot high. 1VIr. & Mrs. Scullin <br />agreed to taper the fence as requested. <br />J. Maloney motioned to grant William & Ann Scullin of 4108 Brendan Lane their request for <br />variance (1123.12), wluch consists of erecting a fence and that the follawing variances be granted <br />as amended: <br />1. A 45 foot variance for erecting a fence within neighbors front setback on a comer lot (code <br />requires. 50 feet, applicant shows 5 feet), section (1135.02 (fl(1)). <br />2. A 30 inch variance £or a fence }ugher than 30 inches in a neighbors front setback on a corner <br />lot (code pemuts 30", applicant shows 60"), section (1135.02 (f)(1)). <br />3. A variance for a fence less than SO% open in a neighbors front setback on a corner lot (code <br />permits 50% open, applicant shows less than 50% open), section (1135.02 (fl(1)}. <br />The fence will taper on' the south west side of the lot from 20-feet from the cyelone fence <br />gradually coming down from a 5-foot height to the 4-foot high cyclone fence. The motion was <br />seconded by J. Konold and unanimously approved. Variances Granted. <br />5. Christopher Smith: 3857 Woodpark Lane;(WRD 1) <br />Request for variance (1123.12). The proposat consists erecting a fence. <br />The following variances are requested: <br />1. A 50 foot variance for a fence within required neighbors front setback on a corner lot (code <br />permits 0', applicant shows 50'), section (1135.02(f)(I)). <br />2. A 42 inch variance for a fence higher than permitted within neighbors required front setback on <br />a corner lot (code permits 30", appiicant shows 72"), section (1135.02 (f)(1)). <br />3. A variance for a fence less than 50% open within neighbors required front setback on a corner <br />lot (code requires 50°fo open, applicant shows less than 50% open), section (1135.02 (f)(1)). <br />Which is in violation of Ord. 90-125 section (1135.02 (1)(1)). <br />Chairman Maloney called all interested parties forward to review their request. Mrs. Smith and <br />her brother Mr. Zwolinski, 1V1r. & Mrs. Weber, neighbors each came forward to be sworn in and <br />review the request. 11/Irs. Smith would like to place a.fence around her lot which is a corner lot. <br />The backyatd fa.ces Blossom Road, there is a lot of traffic on the street throughout the day, and <br />the fence is needed for the safety of her children_ The fence will start at the north east corner of <br />the house to the back properiy line. The fence will continue across the rear property line to the <br />south east corner and then continue westerly to the south west comer of the house were there will <br />be a gate. Mr. Maloney questioned how far away the fence would be from the sidewalk. Mrs. <br />Smith indicated that a neighbor requested that the fence be placed in further then 3-feet which <br />they requested_ Mrs. Weber indicated that she was not against the fence she. would just like to <br />make sure they can get out of their driveway. Mrs. Sergi suggested #he fence not start until after <br />the 6-foot bushes. Quite a bit of discussion took place regarding traffic and an electrical easement <br />which runs 5-feet across the applicants rear property line. Mr. Maioney cvmmented that the <br />board wouid like the fence to only come out 11-feet on the north side af the lot and continue to <br />the back of the property line stopping 5-feet from the rear property line.
