Maloney motioned to approve Christopher Smith af 3857 Woodpark Lane his request for <br />variance (1123.12) which consists of a fence and that the following variances be granted as <br />amended: <br />1. A 39 foot variance for a fence within required neighbors front setback on a comer lot (code <br />permits 0', applicant shows 39'), section (1135.02(fl(1)). <br />2. A 42 ineh variance for a fence higher than permitted within neighbors required front sdback <br />on a comer lot (code permits 30", applicant shows 72"), secfion (1135.02 (f)(1)). <br />3. A variance for a fence less than 500/o open within. neighbors required front setback on a comer <br />tot (code requires 50°/a open, applicant shows less than 50% open), section (1135.02 (fl(1)). <br />This fence is to start at north east comer of house out 11-feet run easterly to within 5 feet of <br />rear lot line. The fence will continue to run along back property to south east side of lot then <br />turn westerly to west comer of house. Which is in violation of Ord. 90-125 section (1135.02 <br />(f)(1)). The motion was seconded by W. Kremzar Roll ca11 on the motion; W. Kremzar, T. <br />Kelly, J. Konold and J. Maloney "yes", N. Sergi "no". Variance Granted. <br />6. Scott Sakacsi; 23854 Maple Rid,ge F.d.; (WRD 2) <br />Request for variance (1123.12). The proposal consists of building a shed. <br />The following variances are requestect: <br />1. A 1 foot 2 inch variance for excess height (code permits 12 ft., applicant shows 13 ft. 2 inches), <br />sectian (1135.02 (d)(3)). <br />2. A 1 yeaz variance for a second shed (temporary for 1 year) (code permits one, applicant shows <br />2), section (1135.02 (d)(1)). <br />Note: The existing shed attached to the rear of the garage will be removed after new shed is <br />constructed (within next year). - <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(3)), and (1135.02 (d)(1)). <br />Chairman Maloney called all interested parties forward to review their request. Mrs. Sakacsi, the <br />owner ca,me forward to be swom in and address the request. Mrs. Sakacsi suggested that they <br />wauld like to replace the existing shed which has been in place for 16-years. The shed will store <br />the children's toys and yard tools. Mr. Maloney inquired why the excess 1'.2" height is needed. <br />Mrs. Sakacsi indica.ted that the shed is a kit and that is the height it comes. Mr. Maloney <br />questioned why it would take 1 year to remove the existing shed. Mrs. Sakacsi indicated that it <br />would not take a year and as soon as the new shed is built the old shed will be removed. Mr. <br />Maloney indicated that the board did not want the existing shed to be up for 1-year the board felt <br />60-days would be enough. 1Virs. Sakacsi agreed to the boards time frame. <br />W. Kremzar motioned to grant Scott Sakacsi of 23854 Maple Ridge Road his request for variance <br />(1123.12), which consists of buiIding a shed and that the following variances are granted as <br />amended; - <br />1. A 1 foot 2 inch variance for exeess height (code pernvts 12 ft., applicant shows 13 ft. 2. inches), <br />section (1135.02 (d)(3)). <br />2. A 90 day total variance which starts the date the building permit is picked up from Building <br />Department the new shed is to be erected and the existing shed is to be removed. (temporary <br />for 90 days) (code perrnits one, applicant shows 2), section (I135.42 (d)(1)). <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(3)), and (1135.02 (d)(1)).
