l. A variance for adding an accessory structure to a side yard (code permits 0, applicant shows 1), <br />sect:ion (1135.02 (d)(2)). <br />2. A 4- foot variance for a structure closer to side lot line than permitted (code requires 5 feet, applicant <br />sho-ws 1 foot), section (1135.02 (d)(4)). <br />Note: The 4 foot variance includes the overhang of the arbor. <br />Which is in violation of Ord. 90-125 section (1135.02 (d)(2)), (1135.02 (d)(4)). <br />Chairman Maloney called all interested parties forward to review the request. Brandon and Suzy Walsh <br />came forvvard and were sworn in. Mr. Walsh said they provided photos of the garden arbor they would like <br />to build. I3e said it would need to come up closer to the property line than code permits. Mrs. Sergi asked <br />if any neiā¬;hbors had issues. Mr. Walsh pointed out he spoke directly with neighbors, especially the one <br />immediately adjacent, and they have no problems. Mr. Kremzar asked if the postholes that they dig will be <br />on their pr-operty. Mr. Walsh indicated they will be. <br />W. Krem2;ar motioned to grant Brandon & Suzy Walsh, of 28757 Ording Rd., their request for variance <br />(1123.12) which consists of construction of large arbor and that the following variances be granted; 1). A <br />variance for adding an accessory structure to a side yard (code pernuts 0, applicant shows 1), section <br />(1135.02 (d)(2)). 2). A 4 foot variance for a structure closer to side lot line than permitted (code requires <br />5 feet, applicant shows 1 foot), section (1135.02 (d)(4)). Note: The 4 foot variance includes the overhana <br />of the arbor. Which is in violation of Ord. 90-125 section (1135.02 (d)(2)), (1135.02 (d)(4)). The motion <br />was seconded by N. Sergi and unanimously approved. Variances Granted. <br />7. Lynn F3oros/Jim Christman 6114 Porter Road: <br />Request for variance (1123.12). The proposal consists of erecting a fence. <br />The following variances are requested: <br />1. A15 foot variance for side yard setback on corner lot (code requires 25', applicant shows 19'). <br />2. A 42 inch height variance for erecting a fence higher then 30 inches, (code permits 30", applicant <br />shows 72"). <br />3. A variance for a.fence in the side yard setback which is under the 50% open, (code requires 50% <br />open, applicant shows under 50%). <br />Which is in violation of Ord. 90-125 section (1135.02) (fl). <br />Chairman Maloney called all interested parties forward to review the request. Mr. 7im Christman came <br />forward tc) be sworn in. He explained his fence was blown down in a recent storm. They would like to go <br />out towar(i the street 6' and then replace it. It would give them a more usable back yard because they are <br />on a corne;r. Mrs. Sergi asked where the fence would start. Mr. Christman confirmed it would run from the <br />post to thf: driveway. <br />J. Konolel motioned to grant Lynn Boros/Jim Christman, of 6114 Porter Rd., their request for variance <br />(1123.12) which consists of erecting a fence and that the following variances be granted; 1). A 6 foot <br />variance for side yard setback on corner lot (code requires 25', applicant shows 19'). 2). A 42 inch height <br />variance for erecting a fence higher then 30 inches, (code permits 30", applicant shows 72"). 3).
