? <br />Request for variance (1123.12). The proposal consists of a new garage. <br />The following variances are requested: <br />1. An S foot 6 inch variance for rear yard setback garage too close to rear yard line (code requires <br />10' applicant shows 1' 6") section (1135.02 C2). <br />2. A 10 square foot variance for exceeding allowable square footage of an accessory structure <br />(code permits.390-sq. ft. applicant shows 400-sq. ft.) section (1135.02 D2). <br />Which is in violation of Ord. 90-125 sections (1135.02 (C2) &(D2)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Christian, with <br />Classic Home Improvements and Mr. Jarrell the owner of Classic home improvements each came <br />forward to be sworn in and address the request. Mr. Christian showed pictures to show why the <br />garage could not be place to code. The existing garage overlaps the house by 6-feet 9-inches now. If <br />the variances are not granted the garage will be halfway into the back yard. In addition, an existing <br />tree would have to be removed to accommodate the garage. Looking at the garage at the house <br />behind them which is lined up with the existing garage. They will just build the new garage in line <br />with that. The fence is on the applicant's property line so the garage will be about 24-inches from <br />that. The board members indicated that neither the applicants nor the board members know what the <br />distance truly is. NIr. Christian indicted that the owner does not what to have the garage in the middle <br />of the back yard. The existing garage is a one-car garage and the owners need to have a 2-car garage. <br />There was a lengthy discussion regarding the lack of a survey being conducted to determine the <br />property lines for accurate measurements. Mr. Christian invited the engineering department to visit <br />the site and mark off 18-inches from the rear line and sideline and he will follow that. Mr. Kelly <br />remarked that there should be clear definition as to the property line boundaries before the board <br />moves any further with this proposal. Mr. Christian suggested that the garage would be 18-inches <br />away from the rear fence and 1 S-inches from the sideyard. Mr. Kremzar suggested that there is not <br />enough information for this proposal to be ruled on. Mr. Maloney questioned what the building <br />department thought of the measurements. Mr. Rymarczyk indicted that the building department can <br />only go by what is submitted by the applicants. Mr. Maloney suggested that the board could approve <br />the request subject to a survey and the engineering department approving the drainage. Mr. Christian <br />suggested that the downspouts would be connected to the existing drainage system. He further <br />voiced his opinion regarding the cunent codes and how they should be changed. <br />J. Maloriey motioned to grant Berry Paden of 23831 Maple Ridge Road his request for variance <br />(1123.12). Which consists of a new garage as amended and that the following variances are granted: <br />1. An 8 foot 6 inch variance for rear yard setback garage too close to rear yard line (code requires <br />10' applicant shows 1' 6") section (1135.02 C2). <br />2. A 10 square foot variance for exceeding allowable square footage of an accessory structure (code <br />permits 390-sq. ft. applicant shows 400-sq. ft.) section (1135.02 D2). <br />3. A 3-foot 6-inch sideyard setback variance (code requires 5 ft, applicant shows 1.6 ft), section <br />(1135.02 CZ). Note: the approval is contingent upon the applicant having a survey of the lot done <br />and Engineering Department approving the drainage system proposed for the garage. <br />Which is in violation of Ord. 90-125 sections (1135.02 (C2) &(D2)).
