The Building Department must receive the adjusted plans <br />to determine if additional variances are required. Mr. Rymarczyk informed the applicant that the <br />Law Department would need to receive a copy of the easement drawn up for the two properties. <br />Mr. Bradford indicated that the property will be owned by an affiliate and a reciprocal agreement <br />for access-way and cross parking will be put on record at the time the properties are acquired. Mr. <br />O'Malley indicated that the Law Department would like to review the documents in advance and <br />request that that be made a condition of any approval. Mr. Bradford indicated that he would <br />forward the agreement to the Law Department right away. Mr. O'Malley questioned if trash <br />receptacles were allowed in the front setbacks. Mr. Lasko indicated that the trash enclosure faces <br />Dover Center Road according to the blue prints. The trash enclosure will need to be moved to a <br />different area. Mr. Rymarczyk indicated that the dumpster is part of the business activity wh'ich is <br />not allowed in a front 75=foot setback. However, if the applicants receive the variance for the <br />building the dumpster could be placed 50-feet back. The Planning Commission can _also require <br />the dumpster to be located at the rear property line as well. Mr. Bradford indicated that they would <br />be happy to move the dumpster to any location the board wanted. Mr. Spalding voiced that he is <br />concerned about placing an additional curb cut along Dover Center Road as the existing <br />entrance/egress causes problems for cars traveling north bond on Dover Center Road. Mr. Lasko <br />believed that the island was placed at the existing Dover Center Road entrance to discourage <br />northbound traffic from turning left across the southbound traffic to enter the site. Mr. Deichmann <br />commented that the existing traffic signs prohibiting left-hand turns were not followed. Therefore, <br />the island was put in place to reinforce the signs prohibiting any left-hand turns. Mr. Bradford <br />does not believe the site will generate additional traffic. Mr. O'Malley indicated that the property <br />owners are within their legal rights to have the traffic signs and island at the Dover Center curb <br />cut. Mr. Bradford indicated that the new building would only require one curb cut and the existing <br />cuts would be removed. The owner's wish is to clean up the entire area, to improve the <br />appearance of the shopping center. Mr. Lasko requested to see the color rendering for the site. <br />Mrs. O'Rourke does not think that the new building will match the existing center, as the fagades <br />_ <br />are not the same. Mr. SpaTding quesfioned if the liazardous sigris facirig the buildrng wou <br />remain. Mr. Bradford indicated that the signs are in place to identify an existing ground well, <br />which is required to be tested on an ongoing base from a court order. W. Spalding suggested that <br />the landscaping along Dover Center Road would need to be improved to keep the site from looking <br />like a warehouse. Mr. O'Malley suggested sending the proposal to the Architectural Review <br />Board. Mr. Lasko indicated that the board would need to see complete plans. Mr. Spalding <br />questioned if the building would remain 1 story. Mr. Bradford indicated that there are specific <br />height requirements that have been set by the rear owners. Mr. Spalding indicated that the <br />applicants would return with a complete set of plans, which will include photometric. The <br />applicants need to work with the building department regarding the trash enclosure being moved, <br />parking requirements and photometric plans. The proposal will be tabled until the next meeting. <br />Mr. Bradford requested that the board allow the proposal to move on to the Board of Zoning <br />Appeals to receive the variances needed, then return. Mr. Spalding questioned if the board could <br />send the application to Board of Zoning Appeals on variances only and then have them return. Mr. <br />O'Malley indicated that the board was within their rights to send the proposal to the Board of <br />Zoning Appeals with a recommendation to approve or deny the variances. The board can also <br />choose to send the proposal to the Architectural Review Board for landscaping, and architectural <br />comments before having them return to Planning Commission. <br />W. Spalding motioned to send Linder & Associates (Water Tower Square) of 4998 Dover Center <br />Road to the Board of Zoning Appeals. The Planning Commission recommends that the variances <br />required be approved. The proposal will then go before the Architectural Review Board for their <br />7
