Lasatda suggested that the property has sat vacant for many years and in fact, the owner sewed <br />the City in the 60's aver the easement. The Title Company did in fact find the easement records, <br />which will be recorded in the recard to make sure it does not, come up again. There witl be 22 feet of <br />green space aext to Mr. Skemtt's property although it is not his. Mr. Skerritt questioned if he could <br />do anything ta keep it from taking place. Mr. Lasardo questioned if Mr. Skerritt would be interested <br />in purchasing .10 feet of land, as he would not need it . to meet building requirements. Mr. Koeth <br />suggasted that the applicant discuss the.issue ofthe sale ofland later. R. Koeth.motianed to approve David Lasardo his_ L,ot. split and Consolidation Plat for Suminerland <br />Ave. Property. The. proposal is to spiit 0,12 acres (approximately 20' by 244') fram Perma:nent parcel <br />Number 237-1 1-016 and consalidate it with Pemtianent Parcel Number 237-1I-059. The location of <br />the .property is on the north side of Summerland Ave. and approximately 300 feet east of Clague <br />l.toad. Zoning is C-Residence, Single. The cansolidated Parcel number 237-11-059 will conform to <br />frantage requirements of the Zoning Code. Required frontage is 60 £eet. The proposed frontage will, <br />be 70 feet. The existing frontage is 50 feet. Parcel Number 237-11-059 has an existing 10 foot wide <br />sanitary sewer easement through it. The motion was secQnded by K. O'Rourke; roll call on the <br />motion; K. Q'Rourke, T. I3reha, S. Asseff, J. Laska and R. Koeth "yes". C. Allen stated the Mr. <br />Skemtt was a friend therefore, he would abstain. Froposa;l consists of a Professional Planner (Mr. George Smerigan) assisting Planning Commission in <br />their duties to make recommendations to Council on the issue of zaning Pazce1 E. <br />Mr, Koeth invited W. O'Malley to introduce the planner that has been hired. Mr, O'Malley <br />indicated that Mr. Smerigan is present to assist the Planning Commission in their duties to make <br />- recommendations to Gouncil on the issue of zontng Parcel.E. The planning commission was <br />requested to rezone the land from 4ffice Building to another use, Plazming Cammissivn declined to <br />rezone the property and the owners of the land took the issue to court. Judge Porkony ruled that the <br />Office Building zoning was unconstitutional as applied to the properiy. The City appealed to the e <br />district court of appeals and the discussion af Judge Porkony was aiTirmed. Part of Judge Porkony <br />verdict was ta remand the issue of rezoning back to the Planning Cornmisaion under chapter 1127. <br />Under this chapter, the Planning Commission is to make a recornmendation to council on the zorung <br />of this parceI., Mr. Smerigan is a professional Planner, has repre5ented many communities, and is <br />familiar with this site and North 0lmsted's code. What- is not before this board is any plan 'or <br />presentation. The Planning Commission is consulting -the planning expert to help the Cpmmission <br />advice council on how the property should be zoned. Mr. O'Malley recomme'nds the Planning <br />Commission listen to what the planner has to say at this time and decline cnmment from the audience <br />for now. Tt would be beneficial to keep the £ocus on the broader zoning question rather then specific <br />site issues. Mr. Smerig;an indicated that he is the president of North Staz Planning and Design firm, <br />which is a multi-consulting firm. The firm serves both private clients and Murucipalities.
