Mr. Deichmann reviewed that the 4-inch outlet is <br />preferred however the applicant requests the right to use a 2-inch outlet and decrease the storage <br />volume. This site is required by code to have a minimum volume of 2-inches multiplied by the <br />hard surface area. He indicated that he could not remember any development along Lorain Road <br />ever being granted a variance to deviate from the minimum volume. Mr. Spalding questioned if <br />what the applicant is requesting could cause problems. Mr. Deichmann suggested that the intent of <br />the ordinance was to enact a stricter requirement then what previously existed to cut down on peak <br />flows the entire length of Lorain Road. Ultimately it would affect the residential area either north <br />or south as the branches go both ways. Mr. Spalding questioned if the applicant could adapt their <br />storm water run off to meet North Olmsted's requirements. Ms. Galvan suggested that several of <br />their engineers felt that they would not need the entire 2-inches multiplied by the hard surface area <br />as far as storage. A 4-inch outlet will allow water to release at a much higher rate then what code <br />requires. The storage size is not an issue it is the allowable release rate. They are required to store <br />8,200 hundred cubic feet the proposed plans show 4,000 thousand cubic feet which is about half <br />what is required. They can store the 8,200 cubic feet required. The problem is the runoff rate <br />allowed by code is making it difficult to control the amount running off. They would like a variance <br />on the storage and the outflow. We can bump up the size of the storage but, the outflow rate can <br />not be reached. Mr. Deichmann repeated. to the commission that he is not aware of any <br />development along Lorain Road, which has been allowed to reduce the minimum storage volume. <br />The engineering department does not recommend a 2-inch outlet because they clog so easily. He <br />recommends that a 4-inch outlet be used. He understands there may be times that the release rate <br />will increase however that would be off set by a larger storage unit. Ms. Galvan suggested that they <br />do not have the room for more pipes. Mr. Deichmann coinmented that he is not requiring the <br />applicants to store more then what is required. Ms. Galvan suggested that if they are allowed to <br />have 81200 cubic feet and run it through a 4-inch orifice. With the Engineering Department <br />understanding that certain storm events would make them rise above the allowable release rate. <br />Then they would be happy to accommodate the City. <br />W. Spalding motioned to approve ituby Tuesday Inc.; 26770 Lorain Road; 232-26-004, 232-26-003 <br />which consists of demolition of existing building (Elias Big Boy) and the construction of a 5300 <br />square foot restaurant (with liquor sales). With the following recommendations; (1). The <br />applicants are to follow all the recommendations of Architectural Review Board and forester i.e. <br />colors, designs on structure, landscaping. Work with forester to preserve all existing trees. (2). <br />There is to be a right exit only on the east entrance of the site. (3). Retention system; It is <br />recommended to maintain what the code requires for storage of the site. As far as the release rate <br />applicant is to work with City Engineers to satisfy City requirements i.e. 4-inch outlet or whatever <br />engineer department requires. (4). The front south parking is to be ]andbanked which is agreed to <br />and that shields are to be used on the perimeter lights of the site as agreed. The motion was <br />seconded by K. O'Rourke and unanimously approved. Motion Carried. Note: the clerk announced <br />that the Ruby Tuesday proposal would go before the Board of Zoning and Development board on <br />March 13, 2002 at 6:30 p.m. and no further notices would be released. <br />IV.
