. <br />, <br />guardrail would in deed be removed. Mr. Hreha reminded the applicant that the landscaping <br />would have to have an irrigation system. Mr. Spalding questioned what type of landscaping <br />would be along the boarders of the lot. Mr. Knouse suggested that they would be placing sod <br />along the boarder of the lot. Landscaping will be placed at the north west and east corner of the <br />lot as well as beds around the building itsel£ Additional landscaping will be added to the front <br />in the landbank parking area. Mr. Koeth questioned the lights on the awnings. Mr. Knouse <br />suggested that those lights will be down lit for the awnings. Mr. Koeth commented that the <br />board wanted no exposed neon Iights on the building. Mr. Spaldino, questioned if the curb cuts <br />would be lined up with the existing traffic light. Mr. Knouse suggested that they may. use the <br />same entrance and egress that is currently in place. The east curb cut will be entrance only and <br />the west curb cut will be exit only. Mr. Koeth inquired if the fagade was E.F.I.S.. Mr. Knouse <br />suggested that the front would be split stone face and E.F..I. S. Mr. Spalding questioned if all <br />Ruby Tuesdays were built of the same materials. 1VIr. Knouse suggested that he was not sure if <br />all were built of the same inaterials. Mr. Hreha questioned what the hours of operations were. <br />Mr. Knouse believes they will be open from_ 5:00 p.m. to 11:00 p.m. and until 2:00 a.m. on <br />weekends. There are some issues regardina the sale of liquor so he is not sure what the exact <br />hours of operations will be. Mr. Koeth requested the Assistant Law Director review the Law <br />Directors opinion. Mr. O'Malley reviewed that the state board for liquor control would deal with <br />the liquor permit for this establishinent. The North Olmsted City Zoning Code can not contradict <br />or conflict with the state law. Therefore, there is a zoning code on the books which is in effect <br />unenforceable or does not trump the State Law. The City however could object but City Council <br />did not object to the Iiquor permit being issued. The church can inquire if they chose to do so <br />however those issues must deal with heath and safety issues. The ]iquor control board can look <br />at whether or not this facility would influence the neighboring uses i.e. church, school and <br />playgrounds. <br />R. Koeth motioned to send Ruby Tuesday Inc. of 26770 Lorain Road PP # 232-26-004 and 232- <br />26-003 which consists of demolition of existing buildinD (Elias Big Boy) and the construction of <br />a 5300 square foot restaurant (with liquor sales). With the following recommendations; (1). The <br />City Forester is requested to view the site for recoinmendations, noting that the Planning <br />Commission would like to see the front parking spaces landbanked and meet with the applicants. <br />(2). The applicant is to have cut sheets for the lights as well as photometric plans. (3) The curb <br />cut issue is also to be resolved when the applicant returns to Planning Commission. The motion <br />was seconded by T. Hreha and unaniinously approved. 1Wlotion Carried. Note: in the framing <br />of the motion the clerk announced that Ruby Tuesdays would jo before the Architectural Review <br />Board Wednesday, February 20, 2002, at 5:30 p.in. <br />IV. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />V. CpMIvIUNICATIONS: <br />1. Planning Commission needs to address the 2002 schedule submitted for approval. <br />Chairman Koeth indicated that the December 24, 2002 meeting would be canceled due to the <br />holidays. The Planning Commission will take the month of August as their vacation rnonth. He <br />asked that if any board members could not make meetings that the clerk's office be notified as <br />far in advance as possible. <br />2. I'lanning Commission needs to review checklist for approval. <br />9
