he would like to have Mr. Ulewicz make his presentation to the board. Mr. Ulewicz indicated he went <br />to all his neighbors and showed samples of the roof material. They are all aware of the work and have <br />no problem with the project. He said he drove around to see different roof styles and colors in order to <br />make a decision for their home. He then explained how he came across the leaks. He showed a <br />shingle sample to the board and said they have two layers of shingles now. He is planning on ripping <br />out both to re-do it in a proper manner with ice guard, and a 25-year shingle. There was discussion <br />about the current roof color and the proposed new color, which is a dark gray. Mrs. Ulewicz pointed <br />out they viewed a home with that color and it blended in nicely. Mrs. Lord asked Mr. O'Malley to <br />confirm that the commission cannot give the resident an answer tonight even if it comes to a decision. <br />The matter must go back to the building department. Mr. O'Malley said that is correct. The board can <br />express its opinion to the Building Commissioner as to whether this fits within the minor change <br />format and assuming he agreed that it did, he would approve of it as a minor change, and he would <br />touch base with the three members involved in that process who speak on behalf of the entire <br />commission and avoid the circumstance where the resident has to wait until the next meeting. He then <br />reviewed the minor change ordinance and mentioned the issue of urgency. He said perhaps the <br />Building Department saw the change in color, texture, or style as being sufficient to warrant a full <br />hearing. Mr. Ulewicz explained his original plan was to replace the roof in the spring but when he <br />reinoved insulation and uncovered the leaking, his plans changed. Mr. Dailey asked if they can make <br />a motion to ask the Building Commissioner to reconsider his decision that this is not a minor change. <br />Mr. Lang said he would suggest that the Landmarks Commission make a recommendation to the <br />Building Commissioner that the request as made by Mr. Ulewicz has been considered by the <br />Landmarks Commission as a whole in deference to the ordinance for a minor change that they <br />consider it to be a minor change and request the Building Commissioner do the same. Mrs. Lord said <br />they could add the issue of expediency. Mr. Barker said he would agree but if they go that route, it <br />should be a written procedure of going through three members of the commission once again to <br />approve it. He said written permission could delay it another week. W. Lang said that is why he used <br />the language, the "Landmarks Commission as a whole" and in compliance with the minor change <br />ordinance recommends approval and would urge the Building Coinmissioner to do likewise. Mr. <br />O'Malley said the board can do that but its interpretation or opinion on whether or not it constitutes a <br />minor change is not at all binding. Mr. Lang said there is an offsetting paragraph in the minor change <br />ordinance and that is the urgency of the situation. <br />B. Lord made a motion indicating the Landmarks Commission recommends that Mr. & Mrs. <br />Ulewicz's request for re-roo4ing with a different color and a dimensional shingle be considei•ed <br />by the Building Commissioner as a minor change, in this circumstance, due to the extreme <br />urgency caused by leakage. If the Building Commissioner concua-s, he will proceed as though <br />the Landmarks Commission was acting as a comanittee of the whole. The motion was seconded <br />by M. Lang said the board needs to <br />discuss whether they will make a request of the city to include that money in the budget for <br />3
