Herschman questioned how the 531-space total came about as they indicated that they would only <br />store 190 cars in inventory once the building is complete. Mr. 12ymarczyk indicated reviewed <br />what they had counted on site and what had been stipulated in a letter dated the day before stating <br />they required inventory space for 298 and then today it says 190 so the total keeps changing. Mr. <br />Herschman suggested that the owner might store the cars off site however there will only be 190 <br />cars kept in inventory for this site. Further discussion took place as to the number of cars that will <br />be on the site. Mr. Burns the applicants Attorney voiced that they were not clear of the Cities <br />authority for requesting more parking spaces then what they say they will store. Mr. Rymarczyk <br />suggested that the figures are based on past experiences with the dealership. Mr. Koeth voiced that <br />there has been a continuous problem with this site exceeding what they are allowed to have on site. <br />Mr. Burns suggested that they based their figures on City code 1161.05 and they don't exceed the <br />figure so again questioned the need for a variance. Mr. Rymarczyk suggested that under code <br />1161.05 Z it states that the Building Commissioner has the right to make a determination. He <br />suggested that the applicants speak with the Building Commissioner. Mr. Koetla questioned if the <br />site was within code currently. Mr. Herschman was not sure how many cars were currently on the <br />site but thought it might be 500. 1VIr. Koeth voiced that past practice with this site is that they <br />exceed the limit on the number of cars on the site. It was determined that the applicants would <br />discuss the issue with the Building Commissioner. <br />Residents Comments: <br />Councilman Limpert indicated that he was present to voice some concerns the residents have. <br />They want to make sure that the water retention is done properly as there are current issues <br />regarding water problems now in the area. He would also like to see more buffering along the west <br />side and some housekeeping issues taken care of along the ditch. The rear zoning is residential so <br />there is a concern that it will also become pavement to hold more cars. The residents would like to <br />make sure that the area remains green space. They want to make sure that the applicants are upfront <br />about what they intend to do with the green space area, no surprises. Ms. Bata commented that it <br />was asked which residents would be affected by this development and it was never answered. She <br />is on Ranchview and questioned how their area would be affected. Residents were given a chance to <br />review the plans. Mrs. ILeonard voiced that the commissioners had more knowledge of what <br />should be done and asked the commissioners to carefully review the plan to make sure it is what is <br />best for everyone. She also voiced that the abutting neighbors could hear the outside speakers at all <br />hours of the day and asked that it be addressed. 1VIr. Brewer commented that they are not against <br />the development but the site is always a mess, the gravel lot looks bad and cars are parked all over. <br />They want assurances that they are going to clean the site and maintain the ditch that is currently in <br />place. He suggested that some of the area should be made residential. 1VIr. Koeth indicated that the <br />commissions first concern is the residents and they hope that Ganley will address the concerns over <br />the mess on the site and use this opportunity to get the site cleaned up. 1VIr. Burns the manager for <br />the structure group indicated that he would see to it that the rear area would be cleaned up and <br />maintained. Mr. Hreha strongly suggested that the applicants not just clean the area but keep it <br />cleaned. Mrs. Hoff-Smith suggested that the area along the west side be addressed. 1VIr. <br />Hersclxman indicated that they will clean the area and place a 6-foot fence to buffer the residents. <br />He reviewed what it would take to place the water retention in place and what they will do to <br />replace the landscaping area. Mr. O'IVIalley recommended that the commission make <br />recommendations to the Board of Zoning Appeals on the variances that Mr. Rymarczyk has <br />indicated are needed. <br />Chairman Koeth indicated that the Ganley lot split is tabled until the Board of Zoning Appeals has <br />addressed the variances required.
