The property owners tried to sell their land to Wellington but they were not interested. <br />Everyone is entitled to a reasonable use to his or her property and the courts require that. His clients <br />would like to agree to reasonable conditions. His clients that live within walking distance from the site <br />will have surveillance cameras at the site. This is not a typical car wash. You do not have to get out of <br />your car to wash the car you remain in your car through out the process. This would be no less dangerous <br />then stopping at Clague Road for a light. It would not increase or draw traffic it would accommodate <br />existing traffic. They would agree to reasonable recommendations from the board and residents, as they <br />understand it is a tuff issue. They asked that Planning Commission please recommend to Board of <br />Zoning Appeals to approve the use variance. Mr. Fisher indicated that he did not mean to offend anyone <br />in the neighborhood there are nice homes in the neighborhood. Working with other clients in the car <br />wash business there have been times that an area of less desirable means have benefited from the security <br />cameras on the site as you can read the license plates of the cars. Mr. Mingus suggested that the meeting <br />house across the street was put in place within the last few years and does quite well. The proposed lot <br />does not have to be used in a commercial capacity. Mr. Allan voiced his disconcerts of a car wash being <br />proposed in a residential neighborhood. Mr. Lasko recommended that based upon Mr. O'Malley's <br />comments the board should address the concepts rather than the specifics. The applicants are to be <br />commended for the effort they have put into trying to make the building fit into the neighborhood. <br />However, The board is dealing with a residential area that extends from Wal-Mart to Fairview Park <br />boundary line. The board is concerned for the quality of life for not only the residents of single family <br />properties but those of Wellington place as well. He finds no compelling interest for a car wash to be <br />located on the proposed site. <br />J. Lasko motion that it is the recommendation of Planning Commission that a use variance be <br />denied by the Board of Zoning Appeals. C. Allan seconded the motion, which dvas .unanimously <br />approved. Motion Carried. Mr. Spalding echoed the comments and feelings voiced by the other board <br />members and residents. The applicants are to be commended for their efforts but the Planning <br />Commission feels this area should remain a residential use. <br />4. Mr. Spalding suggested that there <br />has been a study relative to the Electro Magnetic effect of overlay equipment such as this near school <br />facilities in California. There are concerns about the effect it could have on children in the schools. He is <br />not sure if Law Department or Building department has any knowledge of such studies. Mr. Conway <br />indicated that he had no knowledge of any adverse impacts. He suggested that federal guidelines do not <br />consider that as a basis for denial. Mr. Lasko suggested that the schools are proposing to place a tower <br />at the varsity football field. On a multiple number of Friday nights during the fall season, the proximity <br />to people sitting in the stands is going to be close. Mr. Koeth questioned if a proposal to place a tower on <br />school grounds would need Planning Commissions approval. Mr. Conway indicated that it would have <br />to come before Planning Commission.
