two purposes. The first is to read a letter into the record from a resident on his street. The letter is <br />from William E. Becka. The board members indicated they received a copy and Mr. O'Grady <br />commented it can be considered part of the record (see attached letter). He pointed out that Mr. <br />Becka's letter is in opposition to the proposed site because of the negative impact on the residents. Mr. <br />O'Grady said that Mr. Satarawala came in, in a tough position, and spoke of the benefits of the tower, <br />at least to the Cingular corporation. He said Mr. Satarawala made the point that Cingular is not his <br />company. He said two weeks ago when the board and residents met there were representatives of <br />Cingular present. He asked if there were any representatives of Cingular present tonight. There was <br />no response. He said at the previous meeting, the board asked if Cingular could return with a <br />representative from O.D.O.T. He said they are losing ground. He is profoundly disappointed that the <br />Cingular company thinks it is good business practice to inconvenience this number of people, and to <br />inconvenience this board, by coming back without O.D.O.T. and without the courtesy of a <br />representative from their own company. He added that IV1r. Satarawala pointed out that this board and <br />this city had approved a tower at the Clague and I-480 interchange. He said the Stearns and I-480 <br />interchange is not Clague Road. It is a different interchange and if you take a look at them, we do not <br />have four different housing groups living in close proximity to that interchange. He said Mr. <br />Satarawala pointed out that according to the letter of the law, O.D.O.T. is within their rights, and <br />Cingular is as well, to establish this tower in this location, and that is absolutely correct. However, <br />there is not just the letter of the law, there is the intent. He said Mr. Satarawala commented that he did <br />not write our code. Mr. O'Grady indicated he did. He attended meetings, he studied the Federal <br />Telecommunications Act. He suggested having a local expert come in to help the city craft a plan that <br />would protect our residents. The intent of our code is to regulate telecommunicatians towers, not <br />restrict them. They selected locations that would have a minimal impact on surrounding residents. <br />They also put in I-480 because quite frankly, as has been pointed out quite correctly by our legal <br />counsel Mr. O'Malley, we did not have the right to restrict them. Interstate 480 belongs to the Ohio <br />Department of Transportation and we do not have the right to say no to them. However, for someone <br />to come in here and say the Ohio Department of Transportation doesn't care about the impact on the <br />residents of the City of North Olmsted, is a misstatement. He thinks for that reason, as they said two <br />weeks ago, they need to have representatives from O.D.O.T. here to listen to this commission and to <br />listen to the residents and hear their concerns. The intent of our code was to encourage collocation yet <br />every time a different telecommunications provider comes to this city, they come with reasons why <br />they cannot possibly collocate. He said as a member of city council in the past, and as the president <br />now, he has sat through and listened to the membership state they are getting tired of that story, that it <br />is absolutely impossible to collocate and they need a new tower. Further, the intent of our code was to <br />minimize the impact on the residents of our city. This location is a bad location and for two weeks <br />Cingular did not listen to the commission and they did not listen to the comments that were made by <br />the residents. They came back with a new person that is not an employee of their company to tell us <br />the same story without any other possible alternatives and that is unfortunate. He said if you were to <br />go to that location and stand in the infield, you will see a lot of trees, and you might think it's not too <br />bad a location but that is at about 6 feet of height. If you go up about 10 feet, you see all the homes on <br />Hastings Drive, and you see the homes down Stearns Road. You would see the first 3 homes on the <br />east side and 5-8 homes on the west side. If you go up to 30 feet, you start to see the homes on <br />Soinerset, and the homes on Stafford. This is a bad idea for Cingular, it's a bad idea for O.D.O.T., and <br />it's a bad idea for the residents of this city. They have to start looking for other locations. North of the <br />interstate, south of the interstate, to him it does not matter. It's a bad idea. If they have to go and put a <br />tower to the south and share there and go to the north and share there in Westlake, then that's what they <br />have to do. T'hey should do that rather than impact this significant number of residents in such a direct <br />and profound way. He thanked the commission for its efforts and diligence. He told Mr. Satarawala <br />he is disappointed with Cingular and he hopes that message gets back to them. He thanked Mr. <br />Satarawala and said he knows he walked into a tough position. Mr. Hreha indicated he would like to <br />add a comment. He said since the audience participation did not happen until after they took their <br />10
