a <br />new landscaping. The landscaping plans have been adjusted to keep the removal of existing <br />landscaping to a minimum. Mr. Spalding questioned who would be responsible for maintaining the <br />proposed trees and landscaping. Mr. Funk reviewed that the ground would be covered in mulch and <br />the church will maintain the landscaping. 1VIr. Conway questioned if the applicants would be using <br />white vinyl or painted board on board fencing. Mr. Funk stated that they would be erecting a white <br />vinyl fence not board on board as shown in the plans. Mr. Conway indicated that the building <br />department had no further issues once the fence is completed. However, there may be engineering <br />issues as suggested in an e-mail he received from the engineering department. Mrs. Becker's e-mail <br />suggested there could be drainage issues needing to be addressed and suggested Mr. Funk speak with <br />the engineering department. <br />Audience Participation; <br />Mr. & Mrs. Davison abutting neighbors came forward to address their concerns. Mr. I)avison <br />indicated that he had not seen the proposed fence or any other plans. The mounds and landscaping <br />that were supposed to be placed along the residents side was not done and he would like to know <br />what is going to be done to block the headlights shining into their homes. He is also concerned that <br />the snow being shoveled in the church parking lot is being shoved onto his property. Mr. Funk <br />showed the Davison's a copy of the plans so they could see what the church would like to do. Mr. <br />Davison questioned were the fence would be placed as he owns a portion of green-space and he <br />wants to make sure his property is not infringed upon. li'Ir. Funk suggested that the fence would be <br />placed 10-feet from the Davision's property on the down slop of the swell. Mrs. Hof-Spnith <br />questioned who would maintain the fenced area and swell. Mr. Funk indicated that the church <br />would maintain the area. Mr. Davison felt that the mounds should have been placed as promised <br />but will live with fence. Councilman McKay indicated that he was compelled to speak as the <br />representative for the proposal has suggested that the reason the work was not completed was due to <br />the fault of the City which is not true by any means. When this proposal was first before the <br />Building Zoning and Development board the board required additional mounding as well as <br />additional landscaping as part of the final approval. After many attempts by the Councilman to <br />reach the Church leader/Minister, the issue was turned over to the Law Department. Once the Law <br />Department got involved, the Church decided to request a minor change, which was denied. IVir. <br />Lasko questioned if there would be fencing along the 54-foot section to the south. Mr. Funk <br />indicated that the vinyl fence would also be placed along the 54-foot south section. Mr. Spalding <br />questioned if the fence would be enough to block the headlights. 1VIr. Funk believes that it would be <br />enough to block the headlights. Mr. Funk questioned if the proposal would have to go to Building <br />Zoning and Development again. Mr. Conway reviewed that the issue would indeed go to Building <br />Zoning and Development, which is made up of Council members. Mr. Lasko questioned what <br />would be done to address the e-mail from the Engineering department. Mr. Conway indicated that <br />the developer needed to talk with the engineering department. Mr. Lasko gave his copy of the e- <br />mail from the Engineering department to Mr. Funk. Mr. Funk indicated that he would contact the <br />engineering department and address any issue they may have. Tlae senior member of the church <br />came forward and indicated that he felt the church had been very cooperative and nothing regarding <br />drainage or engineering matters was ever mentioned until now. The first plans did not include a <br />fence, which will be better and the church is trying to be a good neighbor. Council added the <br />requirements for mounds and landscaping after the Planning Commission approved the plans. Mr. <br />Funk suggested that if the City did not feel the project was complete the occupancy permit should <br />not have been issued. If in fact mounds and landscaping was a condition from the start, this should <br />have been brought up at the occupancy inspection. Mr. Lasko commented that the issue needed to <br />be closed, as everyone is starting to split hairs. The problems are being addressed now and that is <br />why everyone is here. Planning Commission meetings are not held for individuals to come, argue, <br />and place blame on someone or something. <br />3
