The applicant voiced his concern about the loss of five parking spaces by changing to an angled <br />parking design. Mr. Conway advised the applicant that if 90 degree parking is used, code requires <br />a 22 foot aisle. He stated tliat there are eight more spaces than code requires. If angled parking <br />is used, the variance for this would not be required. The applicant wants to be able to <br />accommodate tenants in the future if more parking would ever be needed. In summary, the <br />following requirements are required for the revised plans so that no variances will be required for: <br />• Show all landscape areas will be irrigated. <br />• Loading and unloading spaces with the required minimum area of 12' x 25' between bollazd <br />locations. <br />• Disclosure of gas meter locations or any other obstructions on the drawings is clearly marked. <br />• No variance will be required in connection with height or location of lighting on the north side <br />of property. <br />• Security lighting on the west side of the building be provided and indicated on the revised <br />plans as submitted. <br />Mr. Lasko moved to recommend to the Board of Zoning Appeals that the following <br />variances be granted: <br />1. A 16 foot variance for setback from right-of-way line to parking on corner lots (code <br />requires minimum of 201, applicant shows 41), this setback area is required to be <br />landscaped, section (1139.08) <br />The required setback from the right-of-way line to parking on corner lots is normally 201, <br />however in this case is 5' which takes into account the other accommodations that have <br />been considered, so with the balancing of the two, we recommend that this variance be <br />granted. <br />2. A 10 foot side yard setback for west property line, (code requires 101, applicant shows 0'), <br />this area also required to be landscaped, section (1139.14) <br />In this case, there is no setback or landscaping. Taking into account the nature of this <br />particular parcel and the fact that it borders another commercial property, we <br />recommend that this variance be granted. The applicant stated that the irrigation <br />proposal is included in the plans. <br />3. Section 1165.02 (b) (1) requires a special permit for the alteration and enlargement of a <br />non-conforming structure, as the existing building does not meet the current <br />requirements for the 75-ft setback. <br />A special permit for the alteration and. enlargement of a non-conforming structure is <br />granted. Recognizing that this parcel is unique and what it has been put through to in its <br />prior lifetime and recognizing that this would provide an opportunity to make a dramatic <br />change to this parcel, that the design plans as they have been presented will more than <br />compensate for any other changes that otherwise could have been made and based on its <br />merits, is as good as or better than anything else that otherwise would be done in <br />conformity with that particular section of the code. <br />4. A 5 foot variance for side yard setback from property line, (code requires minimum of 20 <br />feet. Applicant shows 15'). This setback area is required to be landscaped. (code 1139.08) <br />5
