City Engineer Durbin indicated that at the last meeting the <br />applicant did not own all four lots however he is now the owner of all four lots. Mr. <br />Montgomery the owner confirmed that he is in fact the own of the lots and the deeds have been <br />filed and a copy was sent to the Assistant City Engineer. <br />R. Koeth moved to approve Corner Stone Plaza Consolidation Plat, 23420 Lorain Road <br />their proposal to consolidate Permanent Parcel Number 231-26-006 (approximately 0.62 <br />acre, and also known as 23420 Lorain Road) with Permanent Parcels Number 231-26-003 <br />(approximately 0.19 acre), 231-26-004 (approximately 0.18 acre) and 231-26-005 <br />(approximately 0.13 acre). The consolidated parcel will be 1.1391 acres. The location is on <br />the northwest corner of the intersection of Lorain Road and Clague Road. Zoning is Retail <br />Business, General. <br />The existing permanent Parcels Number 231-26-003, 231-26-004, 231-26-005 and 231-26- <br />006 do not conform to the area requirements of the Zoning Code. The required area is <br />40,000 square feet, and the actual area is approximately 8,200 square feet (-003), 7,750 <br />square feet (-004), 5,800 square feet (-005), and 26,840 square feet (-006). The existing <br />Permanent Parcel Number 231-26-003, 231-26-004 and 231-26-005 do not conform to the <br />lot width requirement of the Zoning Code. The existing permanent parcel number 231-26- <br />006 conforms to the lot width requirement of the Zoning Code for the frontage along <br />Clague Road. <br />The proposed consolidated parcel will conform to the area and lot width requirements of <br />the Zoning Code. W. Spalding seconded the motion, which was unanimously approved. <br />Rosati's Custard, 26261 Lorain Road (WRD 4) <br />Proposal consists of minor exterior modifications and site improvements. Note: Architectural <br />Review Board addressed this proposal on 10-20-04. Planning Commission tabled the proposal on <br />11-9-04. Board of Zoning Appeals approved variances on 12-2-04. <br />Chairman Koeth called all interested parties forwaxd to review the request and asked for the <br />department reports. Planning Director Wenger reviewed that the proposal consists of a cooler <br />addition to the old Blimpie's building and site improvements. The Architectural Review Board <br />evaluated the proposal on October lOth and made recommendations for building and landscaping <br />improvements, many of which were made including: <br />• Outdoor seating area <br />• Planter boxes <br />• Bike racks <br />• Fencing to match existing structure materials and color <br />Planning Commission evaluated the proposal on November 9`h and made further <br />recommendations for site improvements and variance recommendations to the Board of Zoning <br />Appeals. The applicant was successful in receiving needed variances from the Board of Zoning <br />Appeals including side and rear setbacks and a special permit for adding to a non-conforming <br />structure. They also made additional improvements to their site plans including: <br />• Added landscape screening around the cooler <br />• Added landscape screening around the dumpster <br />• Added landscape irrigation system <br />• Remove existing non-functioning light pole <br />• Reduce outdoor seating area for safety of customers <br />In meeting with the applicant, they discussed Planning Commission's recommendation to <br />consider seating and landscaped area to the west of the building. This land is owned by the State <br />of Ohio. She does not feel it is appropriate to require an applicant to make improvements to <br />property owned by another party.
