2. A 42 inch variance for a fence in 50 foot front yard setback higher than code <br />allowvs, (code permits 30", applicant shovvs 72"), section (1135.02 Fl). <br />3. A variance for a fence less than 50% open in a 50 foot front setback, (code requires <br />50% open, applicant shows solid), section (1135.02 Fl). <br />Which is in violation of Ord. 90-125 sections (1135.02 (Fl) &(F2)). W. Krennzar <br />seconded the motion which was unanimously approved. <br />11. Famous Dave's, 26410 Great Northern Shopqing Center, WRI) 4 <br />Request for variance (1123.12). The proposal consists of a sign package. <br />The following variances are requested: <br />1. A variance for 3 wall signs on a building, (code permits 1, applicant shows 3). <br />Which is in violation of Ord. 90-125 sections (1163.27 D). <br />Chairman Maloney called all interested parties.forward to be sworn in and review the <br />request. Mr. Baum, with Dave's and Mr. Johnson, the contractor each came forward to be <br />sworn in and address the request. Mr. Baum voiced that they have requested the number of <br />signs to have proper recognition. The building is placed between two streets and the angle <br />of the building does not allow visibility but from one direction. The applicants feel the <br />placement of the building is a unique situation. The Building Department indicated that the <br />Planning Cemmission recommended the variance be approved as the location is unique. <br />W. Kremzar moved to grant Faanous Dave's of 86410 Great Northern Shopping <br />Center their request for variance (1123.12), which consists of a sign package and that <br />the following variance is granted: A variance for 3 wall signs on a building, (code <br />peranits 1, applicant shows 3). Which is in violation of Ord. 90-125 sections (1163.27 <br />D). N. Sergi seconded the motion which was unanimously approved. <br />12. Republic Bank; 26777 Loraan Road: WRD <br />Request for variance (1123.12). The proposal consists of changing an existing pole sign. <br />The following variances are requested: <br />l. A variance for changing a non conformation pole sign, (code does not permit, applicant <br />shows one), section (1163.10 (c)). <br />2. A 1 1/2 foot variance for a sign too close to right of way, (code requires 5 ft, applicant <br />shows 3'/z'), section (1163.26 (b)), (see note 1). <br />3. A variance for 2 ground signs on a lot, (code permits l, applicant shows Z), section <br />(1163.26 (A)), (see note 2). <br />Which is in violation of Ord. 90-125 sections (1163.10 (C)), (1163.26 (A) &(b)). <br />Note: 1. Existing pole sign is 1 foot into right-of-way. Proposed change will bring it 3'/z feet <br />away from right-of-way. 2. Applicant is not requesting to add another ground sign, only <br />change & improve existing sign. 3. Overall height of sign 22 feet. <br />Chairman Maloney called all interested parties forward to be sworn in and review the <br />request. Mr. Blevins, with the bank, and Mr. O'Reilly, with the sign company each came <br />forward to be sworn in and address the request. NIr. O'Reilly indicated that they are trying <br />to make an existing sign more appealing and smaller. They want to take the existing sign <br />down and replace the sign with a new sign. The new sign will be back 4-feet from were it is <br />now the message center will be removed. The feel they have to have a sign and if the board <br />does not approve the new sign they will be back to reface the existing sign. The owner's <br />will not let the bank place a monument sign. The existing pole will not be removed it will be <br />cut down to accommodate the new face sign. The inside of the pole sign will be gutted and <br />there will not be a door. Board asked why a conforming sign can not be placed on the lot. <br />7
