Recreation Commission Meeting <br />September 8, 2003 <br />Page Nine <br /> <br /> <br />Mr. Jesse moved to adopt the Security Regulations for posting, after adding that failure to comply <br />with these regulations would result in expulsion from the premises and/or criminal prosecution. <br />Mr. Gareau asked to what extent the Law Department was consulted on the issue respecting <br />personal property, there being an obvious broad category of case law concerning searching <br />student lockers, etc. His concern was entering handbags, packs, duffel bags, etc., or even the <br />ability to actually touch people, which though not included (to pat people down) could cause all <br />sorts of legal complications. Specifically, the last one about the lockers being inspected should be <br />reviewed by the Law Department to make tight regulations as to who is doing it and that it’s done <br />the same way every time and probably by the same group of trained people. Mr. Gareau <br />continued that it’s a sound policy and he agrees with it; he wants to make sure from a legal <br />standpoint there will be no complications. Mr. Jesse said that he agreed with Mr. Gareau and said <br />that the Security Regulations will be given to the Law Department for review. Anything relating <br />to inspection will be done by the Police Department. Instead of “The right of Recreation <br />Department staff to inspect” will be changed to “The right to inspect”. Mr. Gareau said that this <br />goes beyond a comparison to schools as suggested by Mr. Jesse because there are people coming <br />to the Rec Department paying a fee versus students who are required there. Mr. Gareau <br />suggested that the Law Department review the Security Regulations before Mr. Jesse’s motion is <br />placed before the Commission. It poses a lot of concerns. Lockers are common with students <br />and patrons, but what gets them into a school or Rec Center is different, and there may be a <br />different expectation of privacy for someone who is paying a fee vs. a student, whose locker is in <br />a hallway. There may be different standards that apply. After discussion, it was agreed that the <br />Law Department review the Security Regulations before posting. <br /> <br />Mr. Jesse moved that the proposal from Joe Rice & Associates be accepted as presented for <br />$1,935.00 and recommend to the administration, and the Mayor and particular, that the City <br />retain Joe Rice & Associates for security, phase two. Mr. Baxter seconded the Motion. Ms. <br />Hayes asked the Commission for questions. Mr. Kelley asked if the $1,935.00 would come from <br />the Parks & Recreation Budget or the General Fund. Mr. DiSalvo said that it would come from <br />the Parks & Recreation Budget. Roll was called; all were in favor, and the Motion passed <br />unanimously. <br /> <br />This concluded the Report of the Safety Director. <br /> <br />NEW BUSINESS <br /> <br />Financial Reports <br /> <br />Ms. Hayes stated that the financial reports will be reviewed next month, and the Commission has <br />received the guest presentation.
