Property is zoned B -One Family Residence. <br />The following variance is requested: <br />1. An 18 in. height variance for a fence constructed on a corner lot in the side yard; code <br />permits 30 in., applicant shows 48 in., Section 1135.02(D)(3). <br />Note: Fence is proposed to be setback 1 ft. from the sidewalk (street right-of-way). <br />Mr. Aspery stated that the applicant is proposing to replace the existing split rail fence with a <br />vinyl rail and post fence enclosing their rear and east side yard. The proposed fence meets <br />opacity requirements but exceeds the maximum allowable height by 18 inches. The proposed 1 - <br />foot right-of-way setback would be allowed but for the proposed fence height. Mr. Latas clarified <br />that the fence would be installed three feet inside the sidewalk where the existing fence is <br />located. The fence would have 1 -inch rails with 3 inches of space between them so it would be <br />75% open. The fence would keep their dog in and other animals out. He did not think a 30 -inch <br />fence would look aesthetically pleasing. There are also elevated garden beds inside the existing <br />fence so the new fence needs to be higher to counter the additional height. Mr. Raig asked if the <br />fence would be the same height all around, Mr. Latas said it would be.
