availability of a fax machine. Chief Ruple explained the department would have to wait for <br />the final report to be received. He noted the reason the fax was requested is because former <br />Chief Viola had announced his retirement. If the fax was not provided there could have been <br />a two week period without a Police Chief as it could take that long to receive the final report. <br />Therefore Chief Viola, with the civil service commission's blessing, requested that the <br />assessment company fax over the results so that they could be announced immediately as this <br />would allow for a smoother transition period. <br />Based on what the commission has seen and heard, Chairman Cummings moved to deny <br />Candidate Hughes protest of April 1, 1998, Seconded by L. Zolar and unanimously <br />approved. Protest denied. <br />Law Director Gareau announced in addition to Patrolman Hughes protest, a public records <br />request has been received from the attorney representing Mr. Hughes. This request was <br />submitted to the law department for review. Mr. Gareau has determined that this request is <br />not subject to public records law as it is specifically exempted under civil service law as being <br />a public record. He noted the law department has the entire file from the assessment <br />including the examinations, the questions, candidates work sheets, notes etc. Mr. Gareau <br />maintained it is specifically provided under the Ohio Revised Code that this information is not <br />a public record. <br />Since all protests have been settled the commission agreed to certify the eligibility list for <br />Police Sergeant. The clerk provided the commission with the results to be certified. Law <br />Director Gareau announced there should somehow be a document from the Civil Service <br />Commission that can be certified to the appointing authority and such document should be <br />signed by the commission members. <br />E. Cummings moved to certify the eligibility list for the Police Sergeants examination the final <br />ranking of the top six candidates are as follows: Walter C. Novak, ranked #1 with a final <br />score of 86.591; Michael J. Kilbane, ranked #2 with a final score of 85.901; David Huspaska, <br />ranked #3 with a final score of 82.401; Victor J. Branscum, ranked #4 with a final score of <br />82.122; Timothy J. Cook, ranked #5 with a final score of 79.283; and Ralph C. Hughes, <br />ranked #6 with a final score of 78.294. The motion was seconded by L. Zolar and <br />unanimously approved. All three commissioners then signed the results and certified the list <br />to the appointing authority. <br />X ADJOURNMENT: <br />Mr. Cummings questioned how many potential openings there may be for the position of <br />Firefighter during the two year period of the eligibility list. Chief Osterhouse estimated their <br />may be about six openings in that two year period. He recommended that the commission <br />test at least"25 candidates for the agility. <br />The meeting was adjourned at 8:00 P.M. <br />Ernest R Cummings, <br />Cornish, Clerk of Commissions <br />
