established for all the positions for the City, the Unclassified Service positions have to be removed <br />which includes: <br />1. All officers elected by the people. <br />2. All directors of departments. <br />3. The members of all boards or commissions appointed by the Mayor or the Council. <br />4. The Clerk of Council and the Secretary of the Civil Service Commission. <br />5. Superintendent, Assistant Superintendent, Division Heads, and Assistants to Division Heads, <br />except the Police Chief and Fire Chief. <br />6. All unskilled laborers. <br />7. Three secretaries, assistants, or clerks to the Mayor, one (1) secretary to each Director or <br />Department Head, and all temporary part-time office help. <br />The commissioners must address the Treatment Plant regarding their positions, they currently have <br />two chemists, five Technicians, a Supervisor, Forman Equipment Operators, and Operators. His <br />letter further suggests that there was a list from 1995 that was accurate. Mr. O'Malley thought the <br />Law Directors letter suggested that four positions within the Waste Water Treatment were noted as <br />classified in 1976, however since then the list provided by the secretary in 1995 did not include <br />those positions. He suggest the commission start with that classified list and from that point <br />forward compare it to the list from Personnel to determine which positions have been created or <br />eliminated without the Commissions input. Mrs. Rote suggested that as Council creates or removes <br />positions their clerk would have to provide the information needed to determine what position have <br />been created and removed since 1995 and she would also require a 1995 personnel list. Mr. <br />O'Malley suggested that, that would not be needed. The secretary could compare the 1995 list with <br />the current list to help her narrow the list down to those, which may be questionable. Mr. Thomay <br />indicated that the commission has to create a list depicting every position that will be un -classified <br />as well as Classified. The Chairman instructed the secretary to start with the lists provided by the <br />Personnel Department and add fields to the list for classified and un -classified. Then go through the <br />list mark all those titles that are clearly un -classified as such and list the number it corresponds to in <br />the charter. Also mark all positions known to be classified as classified, then the commission can <br />review that list at the next meeting to get an idea as to where to start. All those positions that were <br />on the 1995 list will be identified, then dates of all those positions created since 1995 should show a <br />created date. Mr. Binggeli questioned if a union employee can be civil service as well as be in a <br />union. Mr. Thomay reviewed that an employee can be in the union as well as be in a classified <br />position. Mr. Binggeli reviewed that it was not his intention to create a lot of work for the <br />commission by asking the question he did, and he is sorry if it has placed a burden on anyone. Mr. <br />Thomay assured Mr. Binggeli that the commission had needed to address this question for a long <br />time so he should not feel bad for asking a legitimate question. He commented that Mr. Dubelko's <br />letter suggests that the commission take into account changes to the positions, duties, and <br />responsibilities while researching the question. Mr. O'Malley believes that the Law Directors <br />letter suggests that the commission start with the 1995 Classified list and from that point forward <br />make a distinction. Mrs. Giesser suggested having a meeting during working hours at City Hall to <br />meet with each Director and Personnel Director to review each job position within each department. <br />Mr. Dubelko's letter advises that the commission should have an understanding of each of the <br />position duties and responsibilities. She does not want to make an arbitrary decision. Mr. Thomay <br />questioned if personnel had a job description for every position within the City. Ms. Farver <br />reviewed that in some cases the job descriptions are included in the legislation, which created the <br />position. In other cases, there has been no legislation creating the position and just funding the <br />position created it. In those cases of funding it may or may not include a job description. The <br />department may have a practical job description but that does not mean that it was approved by <br />legislation. She questioned if the Commission was responding to a request from the Law Director. <br />Mr. O'Malley reviewed that the commission received an inquiry from Mr. Binggeli as to whether <br />or not his position is classified or un -classified. Ms. Farver questioned if all this research being <br />conducted was to answer Mr. Binggeli's question. Mr. O'Malley commented that beyond the <br />attempt to answer Mr. Binggeli's question the role of the Civil Service Commission in it's duties to <br />maintain a classified list and how to go about discharging that list. Mr. Thomay reviewed that in <br />the process of trying to answer Mr. Binggeli's question the commission noticed that there were <br />other positions, which should be questioned. The Civil Service needs to research this and get a <br />current list certified. He agreed with Ms. Giesser that the commission should meet during the day <br />to meet with the Directors. Mr. O'Malley recommended that the commission first review the <br />information requested for their next meeting.
