always requests all the funds required to fulfill their duty of having valid lists. However, they are <br />only provided enough funds to fulfill the Police and Fire departments needs. Mr. O'Malley <br />suggested that the Law Director has voiced that he agrees with the commissions concerns and <br />suggested that the Commission just address the lists that are of the most need. Mrs. Rote indicated <br />that by following that practice the Civil Service is now constantly being thrown into 90 -day testing <br />cycles. Every time a Director needs to hire an employee and the Civil Service does not have a valid <br />list of eligible names, it throws Civil Service into a 90 -day cycle to complete a test as does <br />provisional hiring. Mr. O'Malley suggested that if the provisional hire remains beyond the 90 -days <br />then he is not competing with others but merely needing to pass the test to retain his position. If the <br />test is not administered beyond that then the candidate is grandfathered, unless the appointing <br />authority determines to release him during his probationary period for no reason what so ever. It is <br />possible that a provisional hire can become a classified employee in the absence of a test. Ms. <br />Giesser questioned if within the 90 -days the Commission did not administer a competitive exam, <br />would he/she provisionally hired not be required to be tested and considered a permanent appointee <br />according to page 21 (d). Mr. O'Malley felt that the referenced page referred to if the period went <br />beyond six months or the employee's probationary period the test becomes a mute point. Currently <br />the Building Department is down three inspectors and the intent of the Building Commissioner is <br />not known. However the add placed has provided a good number of applicants. Each applicant is <br />required to hold a state certification or obtain it in order to be qualified for the position so there are <br />some assurances other than a competitive exam. He suggested having the secretary research the cost <br />of administering a Building Inspector exam and gather information for the commission. Mrs. Rote <br />voiced that she has received a bid from the only company, which administers a Building Inspector <br />exam. The office would provide all the documents gathered last year when the commission was <br />going to administer the exam for review at next meeting. <br />V. NEW BUSINESS: <br />Commissioners need to address 4 protests received regarding the Assistant Fire Chief test: <br />Mr. Thomay indicated that there were four protests filed regarding the Assistant Fire Chief written <br />exam administered. <br />Protests submitted; <br />1. There was two (2) protests filed on question number #54 pertaining to the Fire Chief s <br />Handbook, 5th edition. The testing agency's recommendation is to deny the appeal, as the <br />question is correct as keyed. <br />The commissioners voiced that they reviewed all the documents submitted regarding the (2) protests <br />filed on questions #54 and they agree that the protest should be denied. <br />J. Thomay motion to affirm question #54 the answer (D) 1, 2, and 3 is correct. R. Giesser <br />seconded the motion, which was unanimously approved. Protest Denied <br />2. Protest (3) filed is on question number #70 pertaining to the Fire Chief's Handbook, 5th edition. <br />The testing agency recommendation is to deny the appeal, as the question is correct as keyed. <br />Mr. Thomay read allowed the wording in the Fire Chief s Handbook and voiced again he agreed <br />with the testing company. <br />J. Thomay motion to affirm question #70 that answer (C) is correct. R. Giesser seconded the <br />motion, which was unanimously approved. Protest Denied <br />3. Protest (4) filed is on question number #75 pertaining to the Fire -Chief s Handbook 5th edition. <br />The testing agency recommendation is to deny the appeal, as the question is correct as keyed. <br />
