c. A failing grade on any required additional criteria shall cause the removal of the <br />applicant's name from the eligibility list. <br />Section 4: Candidate Transfer: <br />Due to the possibility of different criteria and established passing grades in different <br />testable positions, no person shall be entitled to have his/her name transferred to an eligible <br />list of a lower class in the same series requiring qualifications of the same general <br />character. <br />Section 5: Duration of an Eligible List: <br />The term of each list and the names of the applicants thereon shall be fixed by the <br />Commission, and shall be for a period of not less than one (1) year and not more than two <br />(2) years. Except that any list that has been in existence for more than one (1) year may, at <br />the discretion of the Commission, be terminated at any time in the public interest. <br />Section 6: Insufficient Names Remaining: <br />In the event that fewer than five (5) names remain on an eligibility list, the list shall no <br />longer be considered valid for purposes of appointments to Entry -Level positions. <br />Section 7: Revocation of Lists <br />a. No eligible list shall be revoked except upon written notice to all persons whose standing <br />may be affected and upon an entry in the minutes of the Commission as to the reasons for <br />such revocation. <br />b. An eligible list may be revoked and another examination ordered only when, in the <br />judgment of the Commission such action is deemed necessary by reason of errors, fraud, or <br />obviously inappropriate standards prescribed in the connection with that examination. <br />c. All competitors in an examination that has been revoked, shall be notified by the <br />Commission and shall be advised of their eligibility to compete in a rescheduled examination <br />without filing a separate application and without the payment of an additional fee. <br />Section 8: Disoualif cation and Notice: <br />If at any time after the creation of an eligible list, the Commission has reason to believe <br />that any person whose name appears on any list is disqualified, such person shall be <br />notified given reason for disqualification and offered an opportunity to be heard. If such <br />person fails to appear for a hearing or, upon being heard, fails to satisfy the Coni nission <br />that reason for disqualification does not exist, his/her name shall be removed froin eligible <br />list(s). Reasons for removal include the following: <br />a. The eligible person's application contains a false statement or a material omission. <br />b. The eligible person has a physical or mental disability which would interfere with the <br />proper performance of his/her duties in the position he/she seeks. <br />The eligible person fails to report for, or arrange within six (6) days (Sundays and holidays <br />excluded) of the post -marked date on his notification, an interview with the Appointing <br />Authority. 05-24-2004 Update <br />14 <br />
