The Commission has to determine whether or not <br />testing is practicable. <br />An example of a position that cannot be tested for is the Plumbing Inspector in the Building <br />Department. The Building Commissioner gave numbers and a very utilitarian argument which <br />essentially the Commission would only receive candidates who would either be unqualified or were <br />qualified but does not have a very rare certification. <br />The Road Foreman's test can be as early as September 13, 2008 and the appointing authority is <br />looking for an appointment sooner than September. The Forestry Foreman will be on call 24/7 <br />through whatever time frame it will take after the examination to fill the vacancy. The Commission <br />is treating the Road Foreman position as entry-level. The Safety Director indicated that this is a <br />supervisory position and supervises entry-level positions. A general discussion followed concerning <br />the research of the Charter; unclassified positions; the Road Foreman position is not promotional <br />according to case law. Akron had a similar situation allowed people to apply entrance level and <br />promotional level from an unclassified position to a classified position. The Commission classified <br />positions in 2005; unskilled laborers that are labeled C and D are considered unclassified and <br />Service Laborers A and B are considered classified. The Safety Director indicated the Road <br />Foreman's position should be considered promotional and therefore, can be done by a different type <br />of examination. The Law Director was under the presumption that all positions under the foreman's <br />position were considered unclassified and indicated that the rules do provide for a temporary <br />appointment with a 120 day window. This issue needs to be reviewed more thoroughly and how <br />Akron utilized this testing system. Lakewood has utilized the hybrid testing before. The objective <br />is to hire the most qualified person. The Commission has to decide if this is a testable position; <br />promotional or entry-level; be in compliance with the Charter and any other pertinent laws. The <br />Commissioners concluded that this is a testable position and recommends contacting Ramsey & <br />Associates about alternatives to a written examination; request from the Law Department judgment <br />based on the new information. The Commission does not have a problem with hiring a temporary <br />appointment for the Road Foreman. If a temporary appointment is made, the Service Department <br />will still be down one (1) employee and they are already down eight (8) employees as oppose to last <br />summer. The process starts with the appointing authority choosing an employee to fill the vacancy <br />and then notifying the Civil Service Commission; the Rule indicates, if applicable, the Commission <br />may determine to proceed with competitive testing and establish an eligible list. A motion is not <br />needed due to the Rules in place. Rule IX indicates such noncompetitive temporary appointment is <br />authorized for a period of not longer than one hundred and twenty (120) days. The appointing <br />authority must notify the Commission of the vacancy, its duration, the date and the urgent <br />circumstances related thereto. The Chairman instructed the secretary to contact the testing company <br />and testing site regarding future dates in October for testing. <br />Certify Names for the Corrections Officer Vacancy <br />Mr. Ubaldi made a motion to certify the following seven (7) names and forward to the <br />appointing authority contact information for the position of Corrections Officer: James <br />McWilliam, Steven Kopniske, Jeremy Betsa, Peter Pajunas, Colleen Eynon, Stewart Knapp, <br />and Jeffrey Yost. Mr. Hohmann seconded the motion and unanimously approved. <br />Discuss the Service Director's Email Regarding WWTP Employees <br />The Waste Water Treatment Plant will be following the reorganizational model that was prepared <br />by ATS Engineering, Inc.
