4. A variance for a gravel driveway and parking pad; code requires that driveways and <br />parking pads are constructed of concrete or asphalt, applicant shows the driveway <br />serving the new garage to be gravel; Section 1135.02(B)(2)(b). <br />Motion denied 0-5. <br />18-12921; John Schloss; 25176 Tara Lynn Drive <br />Representative: John Schloss, owner <br />Proposal consists of a fence on a corner lot located 6 feet from the side street right-of-way. <br />Property is zoned C -One Family Residence. <br />The following variance is requested: <br />1. An 18 in. variance for a 4 ft. high fence located on a corner lot in the side yard; code permits <br />30 in., applicant shows 48 in., Section 1135.02(D)(3). <br />Mr. Aspery stated that the applicant is proposing to install an aluminum fence to enclose their <br />rear yard and west side yard. The proposed fence meets opacity requirements but exceeds the <br />maximum allowable height by 18 inches. The proposed six foot right-of-way setback in the side <br />yard would be allowed but for the proposed fence height. The applicant will be required to meet <br />Engineering standards before a permit can be issued since the proposed location is in a drainage <br />easement. Mr. Schloss said the 30 -inch high fence would not contain his large dog. The fence <br />would not be higher than his neighbor's fence and the Engineering requirements will be met. Mr. <br />Allain liked the openness of the fence. Mr. Papotto wanted to include the Engineering <br />requirement into the variance. His only concern was the space between the fences, but it is not <br />within the Board's purview. Mr. Raig liked the openness of the fence and thought it looked nice. <br />Mr. Allain moved, seconded by Mr. Papotto, to approve the following variance for 18- <br />12921; John Schloss; 25176 Tara Lynn Drive, conditioned upon the Engineering <br />requirements being met: <br />1. An 18 in. variance for a 4 ft. high fence located on a corner lot in the side yard; code <br />permits 30 in., applicant shows 48 in., Section 1135.02(D)(3). <br />Motion passed 5-0. <br />COMMERCIAL APPEALS AND REQUESTS <br />18-12852; Chuck E Cheese; 26104 Great Northern Plaza <br />Representative: Robert Walters, Chuck E Cheese manager, 26104 Great Northern Plaza <br />Proposal consists of additional signage. Property is zoned B-3 General Business. <br />The following variances are requested: <br />1. A 12.82 square foot variance for total building sign area; the building is permitted 209.15 <br />square feet, applicant shows 221.97 square feet; Section 1163.25(B). <br />2. A variance for 1 additional canopy sign; code allows 1 canopy sign per building entrance <br />canopy, applicant shows 1 canopy sign not over a building entrance canopy; Section <br />1163.29(A). <br />3. A 16 inch variance for canopy sign extension; code requires canopy signs extend no closer <br />than 4 inches to top of canopy, applicant shows extension 12 inches above top of canopy; <br />Section 1163.29(B). <br />
