11. A 1 ft. 6 in. variance for wall sign height; code permits 4 ft., applicant shows 5 ft. 6 in.; <br />Section 1163.28.C. <br />*See also 1139.04.D: Parking areas may not be located within any required street lawn or buffer <br />zone. See also 1161.04.A: Off-street parking lots shall meet the setback requirements applicable <br />to parking as specified in the zoning district. <br />Ms. Lieber reviewed the project consisted of demolishing the existing building and constructing <br />a new structure. Any previously granted variances will no longer apply since a new building is <br />proposed. The building is shown within the required 75 foot front building setback; a 35.3 foot <br />setback is provided from the Lorain Road right-of-way, requiring a variance of 39.7 feet. A 15.5 <br />foot variance for street lawn depth is requested along the Lorain Road frontage; a minimum <br />depth of 20 feet is required, whereas 4.5 feet is shown. Parking is shown in this required buffer <br />area, which is not allowed by code. Buffer zone variances are also required for all other property <br />lines: a 10 foot buffer zone is required along the east and west property lines where the applicant <br />shows a depth of one foot along each property line, requiring variances of 9 feet per side. <br />Parking is shown in the east buffer zone area. <br />A 30 foot buffer zone depth is required along the north property line as the adjacent property is <br />zoned single-family residential. The proposed depth is 6.5 feet, requiring a variance of 23.5 feet. <br />The landscaping density in the north buffer zone also falls short. Based on the 213 foot property <br />line, two canopy trees, six ornamental trees, ten evergreens and 21 shrubs are required. One <br />canopy tree, two ornamental trees, no evergreens and 64 shrubs are proposed. <br />A variance is required for impervious surface area on the lot; the site plan shows an impervious <br />surface area of 83%; the maximum allowable impervious surface area is 65%, with the current <br />plan exceeding this requirement by 18%. A variance for four parking spaces is required; code <br />requires 30 spaces based on the restaurant's useable floor area whereas 26 are proposed. <br />Signage variances are also required for wall sign height as well as the quantity and size of <br />ground signs. The proposed wall sign is shown at 5.5 feet exceeding the maximum allowable <br />height of 4 feet, requiring a variance of 1.5 feet. This wall sign is the only sign proposed on the <br />building. Regarding ground signs, code allows one ground sign and three are proposed: a <br />monument sign along Lorain Road, a drive through canopy sign and a menu board. The <br />monument sign shows a 6 square foot variance for sign area; code permits 50 square feet based <br />on the height of 12 feet whereas 56 square feet is shown. No information has been provided on <br />the monument sign setback from the west property line or the menu board sign area. Code <br />requires a minimum setback of 20 feet from any side property line and the site plan appears to <br />show the ground sign closer than this distance. The application is missing photometric <br />information. Resubmittal to BZBA may be required if additional variances are identified after <br />this information is provided. <br />Mr. Fabo stated that the lot is narrow and oddly shaped. They tried to balance the zoning code <br />requirements with site safety needs. The dumpster enclosure was moved directly behind the <br />building to keep it further from the residential neighbors but the building then needed to be <br />shifted closer to Lorain Road. The traffic flow would enter the lot from Lorain Road and the <br />queueing line for drive through and the emergency egress would go around the building. This <br />
