Mr. Mackey moved, seconded by Mr. Papotto, to approve the following variance for 19-
13614; Gary Moyse; 6652 Charles Road:
1. A 2 ft. variance for width of driveway serving an attached garage; code allows a
maximum width of 24 ft., applicant shows a width of 26 ft., Section 1135.02(B)(2)(c).
Motion passed 3-0.
19-13615; Megan Garofalo; 25150 Randall Drive
Representatives: Megan Garofalo & Aaron Tabasso, owners
Proposal consists of a fence in the rear yard. Property is zoned C -One Family Residence. The
following variance is requested:
1. A 2 ft. variance for height of a fence in the rear yard; code allows 6 ft., applicant shows 8 ft.,
Section 1135.02(D)(1).
Note: Fence is proposed in a drainage easement. Fence bottom may be required to be elevated to
allow for water flow.
Mr. Aspery said the applicant is proposing to install an eight -foot board -on -board privacy fence
along their rear property line. The remaining fencing surrounding the rear yard is shown at a
height of six feet, but the portion along the rear property line requires a two foot variance for
height. This portion is located in a drainage easement and is therefore subject to Engineering
Department requirements to allow for adequate water flow. Ms. Garofalo said the back of their
property backs up against an alley of a plaza and their home is easily visible by people behind
the plaza. There is an existing five-foot chain link fence. Mr. Tabasso said the additional height
is requested because of the grade difference between their property and the plaza. Mr. Russell
said an additional review may be required for an eight -foot fence. Mr. Papotto thought the
variance is justified. Mr. Mackey believed they should have some privacy from the commercial
property. Mr. Raig pointed out that this is why commercial developments are required to have
some barriers when abutting residential property.
Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 19-
13615; Megan Garofalo; 25150 Randall Drive:
1. A 2 ft. variance for height of a fence in the rear yard; code allows 6 ft., applicant shows
8 ft., Section 1135.02(D)(1).
Motion passed 3-0.
COMMERCIAL APPEALS AND REQUESTS
19-13061: Morris Cadillac; 27048 Lorain Road
Representatives: Randy Phillips
Proposal consists of a pre -owned vehicle sales and major auto repair. Property is zoned B-4
Mixed Use Business. The following variances are requested:
1. A use variance to permit sales of used automobiles; code only permits the sale of used
automobiles when accessory to the sale of new automobiles in the B-4 Mixed-use Business
District, applicant is proposing used automobile sales only; Table 1139.03-1.
