Mr. Mackey asked how the applicant was going to abate the citation, Mr. Hadam said he could
return the area to grass or replace with concrete. Ms. Lieber pointed out that the Cuyahoga
County GIS system overlays aerials with parcel information and the earliest available is 1993.
Because of the limits of information available gravel driveways existing in 1993 were
determined to be "grandfathered" since the date of installation could not be determined.
Mr. Papotto said the driveway has been there a long time and it has been maintained so he did
not see an issue with it. Mr. Mackey observed that the home is the second from the end of the
street and the gravel has been maintained since there are not ruts and had no objection. Mr.
Rahm noticed that the steps were taken care of and did not believe the applicant was appealing
the notice because they are unwilling to comply with the code. Mr. Raig agreed and thought the
driveway was well maintained.
Mr. Mackey moved, seconded by Mr. Papotto, to approve the following variance for 19-
13742; Dan Hadam; 4830 Bailey Road:
1. A variance for a gravel driveway; code requires concrete or asphalt, applicant has an
existing gravel driveway extension, Section 1135.02(B)(2).
Motion passed 4-0.
19-13794; Robert Sharp; 25407 Butternut Ridge Road
Representative: Robert Sharp
Proposal consists of a parking pad. Property is zoned A -One Family Residence.
The following variances are requested:
1. A 9 ft. variance for length of a parking pad; code allows a maximum length of 18 ft.
measured from the existing driveway edge, applicant shows length of 27 ft.; Section
1135.02(B)(3)(b).
2. A 13 ft. variance for width of a parking pad; code allows a maximum width of 20 ft.,
applicant shows 33 ft.; Section 1135.02(B)(3)(b).
Mr. Aspery stated that the applicant is proposing to add a 9 foot by 33 foot extension to their
existing concrete parking pad behind their detached garage in the rear yard. Variances are
required for the length and width of the parking pad: a 9 foot variance is requested for the length
and a 13 foot variance is requested for the width. A parking pad 18 feet in length by 20 feet in
width is permitted by code, whereas the extension would create a parking pad with total
dimensions of 27 feet by 33 feet.
Mr. Sharp has lived in the home for 40 years and there is no on -street parking near the property.
A diseased tree was removed last year. When he moved in, a large accessory structure was in the
proposed spot and the foundation is still there. Mr. Raig asked what the 24 foot by 24 foot
structure was, Mr. Sharp said it is a detached garage since the house has an attached one -car
garage. Mr. Sharp said there are two driveways on the property, one from Butternut and one
from SR -252. Mr. Papotto thought this was a challenging house to visit and did not see an issue
with the proposal. Mr. Mackey thought it would be a good idea to add parking space to allow for
safe ingress and egress from SR -252. Mr. Ra un had difficulty parking when visiting the
property, so he agreed the proposal would improve safety.
