1. A variance for a parking pad in a front yard; code only allows parking pads in the side or rear <br />yard of a residential lot unless the lot has access to an arterial street, applicant shows a <br />parking pad in the front yard; Section 1135.02(B)(3)(a). <br />2. A 2 ft. variance for setback of a parking pad; code requires minimum 5 ft. setback from any <br />property line, applicant shows 3 ft. from side property line; 1135.02(B)(3)(b). <br />Mr. Aspery stated that the applicant is proposing to install a parking pad in the front yard of their <br />property. A parking pad may only be installed in the front yard if there is access to an arterial <br />street; code allows for parking pads in the side and rear yards of non -arterial streets. Since <br />Mackenzie Road is not classified as an arterial street, a variance is required for the parking pad <br />proposed in the front yard. A two foot variance is also requested for the parking pad's setback <br />from the northern property line; a five foot setback is required whereas three feet is shown. <br />Mr. Simonyi said he widened his driveway years ago but now they are having difficulty backing <br />out onto Mackenzie Road. He is replacing his driveway and wants the parking pad to be replaced <br />as well. Mr. Mackey agreed that the proximity to Lorain Road adds to the traffic issue since he is <br />the fourth house down from Lorain. Mr. Raig had no issues with the proposal since it is a safety <br />issue, but he suggested the applicant review the width to ensure there is enough room for a <br />turning area. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variances for 19- <br />13837; Louis Simonyi; 5525 Mackenzie Road: <br />1. Property is zoned C -One Family Residence. <br />The following variance is requested: <br />1. A 2 ft. variance for height of a fence on a corner lot in the side and rear yard; applicant is <br />permitted a 4 ft. high fence, applicant shows 6 ft., Section 1135.02(D)(3). <br />Note: Applicant was previously granted variances for fence setback, height and opacity at <br />August 5, 2004 BZA. A 5 ft. fence setback from side street right-of-way is proposed. <br />Mr. Aspery stated that the applicant is proposing to install a six-foot vinyl fence in the side yard <br />of their home on the corner of Westview Drive and Mitchell Drive. Variances were previously <br />granted for fence setback, height and opacity in 2004. The property was permitted a four -foot <br />fence in the side yard at less than 50% open, whereas they are now seeking to install a new six- <br />foot fence, therefore requiring a variance of two feet. The proposed fence is shown in the same <br />footprint as the current fence, at five feet from the property line. <br />
