Ms. Hughes said she was unaware of the corner lot restrictions. Since 2008, their home has been <br />robbed, the mail has been stolen, the fence was graffitied, and they have found someone <br />watching them from the street. They are close to apartments and business and there have been <br />other incidences with the police in the neighborhood. They want to be able to secure their home <br />and enjoy the property. Mr. Hughes wants to have privacy for his yard. Ms. Hughes provided a <br />list of seven signatures of neighbors showing they had no objections to a higher fence. Mr. <br />Papotto asked if the fence will be a six-foot high wood board on board fence, with no latticework <br />on top, Ms. Hughes said it will match the abutting neighbor's fence. <br />Mr. Mackey did not object since it will improve the existing fence. Mr. Raig was not in favor of <br />a six-foot high fence so close to the sidewalk. Mr. Papotto believed the location of the property <br />warranted a higher fence even though he is not in favor of six-foot fences on the sidewalk. Mr. <br />Rahm observed an unusual amount of foot traffic when visiting the property and was in favor of <br />the proposal. <br />Mr. Mackey moved, seconded by Mr. Papotto, to approve the following variance for 19- <br />13865; Ronald Hughes and Tammy McKay Hughes; 24931 Mitchell Drive: <br />1. A 2 ft. variance for height of a fence on a corner lot in the side and rear yard; applicant <br />is permitted a 4 ft. high fence, applicant shows 6 ft., Section 1135.02(D)(3). <br />Motion passed 3-1, Mr. Raig voted no. <br />19-13908; Abisain Luzo; 6595 Barton Road <br />Representatives: Abisain & Tracy Lugo <br />Proposal consists of a new driveway. Property is zoned A -One Family Residence. <br />The following variance is requested: <br />1. A 6 ft. variance for width of a driveway on a residential lot where a garage is not present; <br />code permits 12 ft., applicant shows 18 ft., Section 1135.02(B)(2)(e). See also Section <br />1135.02(B)(2)(c). <br />Mr. Aspery stated that the applicant is proposing to replace their existing gravel driveway with a <br />concrete driveway. Since a garage is not present on the property, code requires that a driveway <br />be constructed only in the front and side yards in accordance with the restrictions for that <br />permitted for a detached garage. This code requirement permits a maximum width of 12 feet for <br />a driveway section in the front yard, whereas the applicant shows a width of 18 feet, requiring a <br />variance of six feet. <br />Mr. Lugo said his current gravel driveway is 18 feet wide. He wants a wider driveway to allow <br />two cars to be parked next to each other in the driveway. He intends to build a garage at the end <br />of the driveway. The proposed driveway would leave 80% green space in the front yard. The <br />driveway was 18 feet wide when he purchased the property and a contractor has already been <br />selected for the project. Mr. Mackey agreed that the driveway would improve the property. <br />Mr. Mackey moved, seconded by Mr. Papotto, to approve the following variance for 19- <br />13908; Abisain Lugo; 6595 Barton Road: <br />
