Property is zoned A -One Family Residence. <br />Proposal was tabled at August 3, 2020 meeting. <br />1. A 10.73 ft. variance for setback of a fence constructed on a corner lot in the side and rear <br />yards abutting a side street; code requires 20 ft., applicant shows 9.27 ft., Section <br />1135.02(D)(3). <br />The applicant proposes to construct a new six-foot white vinyl fence in the side and rear yard of <br />their corner lot. The fence will be set back from the ROW just under ten feet. The zoning code <br />requires a setback of 20 feet along a side yard of a corner lot. Mr. Lumpkin wants to install the <br />fence for more privacy and would like to extend it past the house to maximize the fenced in area. <br />A gate is proposed to have access to the back yard. If the fence was at the edge of the house, the <br />gate could not be accessible. Ms. Lieber said the lot and its neighbor share a rear lot line. The <br />neighbor's drive to the north is about 90 feet away so the visibility should not be affected. The <br />home is set back about 25 feet from the ROW and the fence will project 15 feet beyond the <br />setback of the house. There is nothing unique about the lot that would make it infeasible to meet <br />the code. An email of support from Julie Lajko and Jeff Reynolds received on August 7, 2020 <br />was read into the record. Ms. Patton asked if the trees along the sidewalk would be removed. Mr. <br />Lumpkin would like to keep the trees inside the fenced area. Mr. Papotto thought having the <br />fence 15 feet from the house seemed excessive, but the proposed location made sense since it <br />would otherwise be in the middle of the trees. <br />Mr. Papotto moved, seconded by Mr. Rahm, to approve the following variance for 20- <br />16925; Dorela Marashi; 26982 Kingston Circle: <br />1. A 10.73 ft. variance for setback of a fence constructed on a corner lot in the side and <br />rear yards abutting a side street; code requires 20 ft., applicant shows 9.27 ft., Section <br />1135.02(D)(3). <br />Motion passed 3-2, Mr. Allain and Ms. Patton voted no. <br />20-17169; Kathleen Garran; 26621 Butternut Ridae Road <br />Representative: Kathleen Garran, owner <br />Proposal consists of a new accessory structure. Property is zoned A -One Family Residence. <br />1. A variance for a second accessory storage building; code permits one per residential lot, <br />applicant shows two, Section 1135.02(C)(2). Note: There is an existing detached garage and <br />an existing barn on the lot. <br />2. A 88 square foot variance for size of an accessory storage building; code permits 200 square <br />feet, applicant shows 288 square feet, Table 1135.02-1. Note: Lot is 37,942 square feet. <br />Existing non -conforming barn is 800 square feet. <br />The applicant is proposing to construct a new 288 square foot storage building on the lot, where <br />an existing detached garage and barn already exist. One accessory storage structure in addition to <br />a detached garage is permitted. The proposed new building exceeds permitted area by 88 square <br />feet based upon lot size. Ms. Garran said the new shed would replace a shed that was torn down <br />a few years ago. The foundation from the previous shed would be reused and the new structure <br />will be the same size. It will be approximately 281 feet from the street. Ms. Lieber said the <br />existing barn already exceeds the permitted area for an accessory storage structure by 600 square <br />
