project, Mr. Allain agreed. Mr. Papotto normally would not like the fence that close to the
sidewalk but since there is a short side yard and a variance was granted previously. Mr. Rahm
thought the land was unique and the owners have a well thought out plan.
Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 20-
17471; Bob & Lisa Everden; 5502 Quail Run:
1. A 16 ft. variance for setback of a fence in the side yard of a corner lot; code requires 20
ft., applicant shows 4 ft., Section 1135.02(D)(3).
Motion passed 5-0.
20-17472; William & Kathleen Turvey; 6631 Chadbourne Drive
Representative: William Turvey, owner
Proposal consists of a shed. Property is zoned A -One family Residence.
1. A 50 sq. ft. variance for maximum storage building size based on lot area; code permits 150
sq. ft., applicant shows 200 sq. ft., 1135.02(C)(2).
The applicant proposes to remove an existing shed on the property and replace it with a new 200
square foot shed. Based on the lot size, a 150 square foot shed would be permitted, so a 50
square foot variance is requested. Mr. Turvey wants to install a shed that will match the house.
The old shed actually sits on ODOT property and will be torn down. A gate would be installed in
the existing fence to access the shed. The garage is needed to store their vehicles because of the
recent break-ins, so the sporting and outdoor equipment would need to be stored in the shed.
Ms. Lieber said the parcel is a standard size for a residential lot. The only unique characteristic
of the property is that it backs up to state property/right-of-way which results in fewer impacted
residential neighbors. A letter of support received from Judith Schwind received on September
10, 2020 and an email of opposition received from Cassandra Rumes on September 13, 2020
were read into the record. In response to the Rumes letter, Mr. Turvey said he spoke with the
Building Department before installing the fence in the reverse direction to shield their garbage
cans. Mr. Papotto asked if the yard floods, Mr. Turvey said a swale runs through the back yard
and may take weeks to dry out. The area can be hard to access most of the time so the shed is
proposed in a different location. Mr. Mackey thought the request was reasonable and thought the
family needs the space, Mr. Allain agreed.
Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 20-
17472; William & Kathleen Turvey; 6631 Chadbourne Drive:
1. Property is zoned A -One Family Residence.
1. A 17 ft. variance for the setback of a fence in the side and rear yard of a corner lot; code
requires 20 ft., applicant provides 3 ft., Section 1135.02(D)(3).
