A variance to eliminate the required buffer zone between the proposed accessory vehicle <br />storage area and adjacent property; code requires a 20 foot deep buffer with specified <br />quantities of plantings adjacent to residential zoning district and 10 foot deep buffer adjacent <br />to commercial zoning district, applicant shows no buffer, Tables 1139.06-2 and 1139.06-3. <br />4. A variance for off-street parking in a required setback; code does not permit, applicant shows <br />five new spaces (labeled 4-8) in required setbacks, Section 1161.04(A). <br />5. A variance to allow asphalt grindings as a parking lot surface; code requires parking lots and <br />vehicle storage areas to be asphalt or concrete; applicant shows asphalt grindings, Section <br />1161.04(B)(1). <br />6. A variance for a dumpster enclosure in a designated parking space; code does not permit, <br />Section 1161.11(B). <br />Ms. Lieber said the city received a complaint for work without a permit in July 2019 and the <br />owners were cited for making unapproved changes, including the removal of trees and vegetation <br />in the rear yard and the installation of gravel for storage of vehicles. The inspection at the time <br />showed that the approved plan for the escape room project had not been completed yet. As part <br />of the violation resolution, the applicant submitted an updated site plan which was approved in <br />February 2020. Since then, only the wood fence was installed. The applicant is proposing <br />additional site changes and uses for the property requiring a number of variances. A use variance <br />is requested for vehicle storage not related to the main use of the property for another business <br />owned by the applicant in North Olmsted. The proposed accessory use without a permitted main <br />use is not permitted in the B-1 Local Business district. The impervious surface coverage is being <br />expanded so a 17.6% variance is needed. The existing lot coverage is non -conforming. The <br />required 20 -foot buffer zone abutting residential properties and ten -foot buffer zone abutting <br />commercial lots is not met. The off-street parking has been reconfigured to show spaces labeled <br />4 through 8 alongside the property line and are in the required front and side setbacks. Currently, <br />there is a two-way curb cut from Lorain Road and the proposed one-way drive widths would be <br />insufficient for vehicles leaving the property. Spaces 9 through 11 are not accessible for <br />customer parking and space 9 is shown on the generator pad. Asphalt grindings is not an <br />approved surface material for parking lots. The dumpster enclosure is shown in the required side <br />yard setback and cannot be in marked parking spaces. <br />Mr. Robinette explained that the owner has a car repair business at another location on Lorain <br />Road and tows vehicles for NOPD and insurance companies. The other business needs to keep <br />the towed vehicles secure and there is not enough space on the other property. The property has <br />two tenants, Escape Room Cleveland and Mickey's Garage. A significant portion of the lot is <br />proposed to be fenced in and be used for vehicle storage. The apartment abutting the property is <br />not visible because there are trees and vegetation. They thought the residences are far enough <br />away that the fence would not negatively impact the neighbors. Damaged cars would be stored <br />and a hard surface would be damaged by vehicles being moved in and out of the space. Only <br />employees would use the fenced area. Mr. Robinette did not believe the buffer zone would <br />benefit the neighbors and the fence would be opaque to provide an adequate buffer. Off-street <br />parking is needed for the escape room customers and he believed 20 spaces would accommodate <br />that use.
