1. A 5 ft. variance for rear yard setback of a detached garage; code requires 10 ft., applicant <br />shows 5 ft., Section 1135.02(B). <br />The applicant proposes to replace their existing garage with a new 20 by 22 foot detached <br />garage. A minimum rear yard setback of ten feet is required and the applicant proposes a setback <br />of five feet. Mr. Schreiner said the new garage met the required setback, there would only be 18 <br />feet between the garage and the back of the house. The lot and driveway are narrow and would <br />not give proper access to the garage. Moving the garage back will give the owner more room to <br />access the garage. Ms. Lieber said the current garage meets the setback; however the lot is <br />existing non -conforming in that it is small, just 7,100 square feet when the minimum for the <br />district is 10,850 square feet. The frontage is 50 feet, where 70 feet is required. Mr. Papotto <br />thought it was a reasonable request, since the lot is small and the site plan shows how tight the <br />space would be if the setback is met. The home behind this lot is on a double lot and has a <br />garage, so he did not think it would be negatively impacted. Mr. Mackey thought the additional <br />space is needed to safely operate vehicles. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 20- <br />17566; Alexander Vega; 5673 Porter Road: <br />1. An 5.6 ft. variance for rear yard setback of a dwelling; code requires 50 ft., applicant shows <br />44.4 ft., Section 1135.06(D). <br />The applicant is seeking approval for a home addition that encroaches into the rear yard setback. <br />50 feet is required and the setback shown is 44.4 feet. Mr. Rabatt has a disabled son and the <br />addition is needed to accommodate the family's needs. Ms. Semaan spoke with the neighbor and <br />she did not have any issues with the addition. The applicants have lived in the home for 19 years <br />and would like to make the home meet their needs. Ms. Lieber pointed out that construction <br />began before permits were issued but the owners have been working with the Building <br />Department to get the required paperwork taken care of. She thought the proposal seems like a <br />reasonable accommodation for their disabled family member's needs. Ms. Patton thought the <br />request was minor and there would not be a negative impact on the neighborhood. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 20- <br />17640; Elias Rabatt; 6071 Gareau Drive: <br />1.
