A 990 sq. ft. variance for area of private garage; code permits 750 sq. ft., applicant shows <br />1,740 sq. ft., Section 1135.02(B)(1)(a). <br />The applicant is proposing to install a new garage with a covered porch. The garage is 1,740 <br />square feet, including the interior and exterior areas, which is 990 square feet greater than code <br />allows. An existing garage and shed will be removed. Mr. Scott has lived in the home for about <br />14 years. The current outbuildings are aging and they would like to build one structure to replace <br />them. The structure would be used for two vehicles, lawn maintenance equipment, and outdoor <br />recreation items. The additional patio would be used for entertaining guests. Ms. Lieber said the <br />request was substantial. Mr. Papotto asked if this would be the only building other than the house <br />on the property, Mr. Scott said it would be. Mr. Scott said the lot is 1.3 acres and the width of the <br />lot where the building would be is 100 feet. Mr. Papotto thought the request was significant but <br />thought the removal of the other storage structures helped, Mr. Rahm agreed. Ms. Patton thought <br />the request is significant even though part of the request is for the patio and the structure would <br />be an improvement to the property. Mr. Mackey thought consolidating all of the outbuilding <br />space into one lot was a good idea and did not think it infringed on the neighboring lots. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 21- <br />20260; Stephen & Charleen Scott; 4286 Porter Road: <br />1. A 990 sq. ft. variance for area of private garage; code permits 750 sq. ft., applicant <br />shows 1,740 sq. ft., Section 1135.02(B)(1)(a). <br />Motion passed 3-2, Mr. Allain and Ms. Patton voted no. <br />21-20277; Alyssa Hansinaer: 5508 Decker Road <br />Representatives: Nick Guenther, owner <br />Proposal consists of a fence in the side and rear yard of a corner lot. Property is zoned B -One <br />Family Residence. <br />1. An 18 ft. 2 in. (approximate) variance for setback of a fence on a corner lot in the side and <br />rear yards abutting a side street; code requires 20 ft., applicant shows approximately 1 ft. 10 <br />in., Section 1135.02(D)(3). Note: The fence is a 4 ft. 5 in. high solid board fence. <br />The applicant is seeking approval for a fence installed in the side and rear yard of a corner lot. <br />The 4 ft. 5 in. solid fence has been installed only about 1 ft. 10 in. off the property line, where 20 <br />feet is required. Mr. Guenther purchased the property recently and there was a row of arborvitae <br />trees lining the property line with a chain link fence running down the middle of them. The <br />bushes were overgrown and blocking the sidewalk so he removed them. He installed a solid <br />fence around the side patio for privacy and to keep the dog contained. Ms. Lieber said she would <br />object to the proposal if it was presented before work was done, unfortunately it has been <br />constructed. She did not think it blocked visibility, which would be her main concern. Mr. <br />Guenther installed the fence without a permit and apologized for his ignorance. He thought the <br />fence would be permitted since it followed the same line as the chain link fence. The email from <br />Roger Godic at 5548 Decker Road was read into the record. <br />
