and terms and conditions of employment for the AFSCME Bargaining Unit Employees <br />(hereinafter "AFSCME CBA ") <br />S. O.R.C. Section 306.35(x) provides, in pertinent part, that if a regional transit <br />authority acquires any existing transit system, it shall negotiate arrangements to protect the <br />interests of employees affected by the acquisition. <br />6. GCRTA and AFSCME currently are in the process of negotiating an "Employee <br />Protection Agreement." The fundamental purpose and scope of the Employee Protection <br />Agreement is to establish terms and conditions that are fair and equitable and which protect the <br />interests of AFSCME Bargaining Unit Employees who will transfer to GCRTA after it acquires <br />fall ownership and control of the City's public transportation system, in full compliance with the <br />provisions of O.R.C. Section 306.35(x). <br />Statement of Agreement <br />NOW THEREFORE, the City, AFSCME and GCRTA have agreed to the following <br />terms, which shall become applicable as of the effective date that GCRTA acquires full <br />ownership and control of the City's public transportation system, pursuant to the Transfer <br />Agreement: <br />1. That the protective arrangements set forth in the Employee Protection Agreement <br />are fair and equitable and in full compliance with the provisions of O.R.C. Section 306.35(x). <br />2. AFSCME has represented to the City that some AFSCME bargaining unit <br />employees may, as a result of the transfer of the City's bus line operations to GCRTA, <br />experience a loss of, or diminution in, certain negotiated employee benefits as a result of their <br />service retirements from GCRTA prior to August 1, 2006, the heretofore expected expiration <br />date of the AFSCME CBA.
