<br />to provide for competition and objectivity in the selection of a firm. In so acting, the director or <br />the board may utilize the processes described in Section 112.07, Section 112.08, a modified <br />version of either process, or some other process designed or chosen that reasonably provides for <br />competitioii and objectivity as stated above. After selecting a firm and negotiating the terms of a <br />proposed personal services contract, the director or board shall submit the contract first to the <br />Director of Law for legal review and approval and thereafter to the Board of Control for award <br />of the contract. <br />(b) In its submission to the Board of Control, the director or board shall include a written <br />statement which: (1) identifies all firms who were contacted with regard to the required personal <br />services; (2) explains the selection process by which the firm was selected; (3) describes the <br />contract negotiation process; and (4) states the total contract price and, if applicable, describes <br />the pricing structure for the contract. The Board of Control shall award the personal services <br />contract to the selected firm far the contract price and on the terms and conditions negotiated by <br />the director or board so long as it determines that sufficient funds have been appropriated and <br />remain unencumbered for the proposed expenditure and that the director or board did not commit <br />an abuse of discretion in either selecting the recommended firm or in negotiating the proposed <br />contract. No personal services contract proposed under this section shall be effective and <br />binding upon the City until it is awarded by the Board of Control, signed by the Mayor, and has <br />attached to it a fiscal officer certificate signed by the Director of Finance. <br />(c) No proposed expenditure for personal services shall be artificially divided into <br />separate expenditures in order to avoid falling within the scope of the expenditure limitations of <br />this section. <br />112.06 PERSONAL SERVICES CONTRACTS INVOLVING EXPENDITURES IN <br />EXCESS OF TWENTY FIVE THOUSAND DOLLARS ($25,000.00). <br />(a) Every personal services contract involving an expenditure in excess of twenty-five <br />thousand dollars ($25,000.00) must be solicited, negotiated and awarded in accordance with <br />either the provisions of Section 112.07 or 112.08 below. The choice of which section to follow <br />is within the discretion of the director or board. <br />(b) In using Section 112.07 or 112.08, the director or board may, at his, her or its <br />discretion, promulgate rules and regulations establishing a"prequalification process" for firms <br />that provide professional services. The purpose of a prequalification process is to permit the <br />director or board to receive and keep on file statements of qualifications on an annual or biennial <br />basis from finns that provide professional services. <br />112.07 REQUESTS FOR QUALIFICATIONS. <br />(a) Prior to initiating the selection process, the directar or board shall obtain legislative <br />approval from City Council to solicit statements of qualifications (SOQ). <br />(b) The director or board shall prepare a request for qualifications (RFQ).
