<br />D. PROPOSAL GUARANTEE <br />No proposal will be considered unless guaranteed for the terms specified in the OVERVIEW AND <br />BACKGROUND above. <br />E. PREPARATION OF PROPOSAL DOCUMENTS <br />The proposal package consists of all items listed on the Tabie of Contents specified for submission. <br />The City does not assume any responsibility for errors or misinterpretations resulting from the use of <br />incomplete proposals. <br />F. OPENING AND CONSIDERATION OF PROPOSALS <br />Proposais will be opehed (unless obviously non-responsive) and availabie for public viewing. No <br />proposal will be accepted from, or contract awarded to, any person, firm or corporation that is in <br />arrears or in default to the Owner upon any debt or contract, or that is a defaulter as surety or <br />otherwise on any obligation to the Owner, or has failed to perform faithfully any previous contract with <br />the Owner. The City of North Olmsted reserves the right to reject any and all proposals and/or to <br />waive technicalities, or to advertise for new proposals if deemed to be in the best interest of the City of <br />North Olmsted. <br />G. AWARD OF CONTRACT <br />Acceptance of a proposal from any vendor by the City shall not constitute an <br />agreement between the City and that vendor and shall not be binding upon the City until such time as <br />an agreement covering all conditions and provisions of the services to be provided by the successful <br />vendor has been reduced to writing and executed by both the City and the successful vendor following <br />review and recommendation by the Board of Control and authorization by City Council. <br />H. REQUIREMENTS OF PERFORMANCE BONDS <br />Before entering into a contract, the successful vendor shall upon notice of award, furnish to the City, a <br />performance bond payable to the City of North Olmsted in a sum equal to One Thousand Five <br />Hundred Dollars($1,500.00) with good and sufficient sureties or with a surety company authorized to <br />do business in the State of Ohio, conditioned on the faithful performance of his contract in accordance <br />with the above specifications. Such bonds shall also indemnify the City against damages that may be <br />suffered by the failure to perform his contract according to the provisions thereof and in accordance <br />with the contract specifications set forth in the finai agreement. <br />1. COMPETENCY OF VENDOR <br />The opening and presentation of proposals shall not be construed as acceptance of the proposal as <br />qualified and responsible. The City reserves the right to determine the competence and responsibility <br />of a vendor from its knowiedge of the vendor's qualifications or from other sources. <br />In the event that the City shall require additional supporting data regarding the qualifications of the <br />vendor in order to determine whether he is a qualified, responsible vendor, the vendor may be <br />required to furnish any or all of the following information sworn-to, under oath by him: <br />A. Evidence that the vendor is capable of commencing performance as required in the contract <br />documents. This evidence may include a list of client references with names of current contacts <br />and telephone numbers for whom the vendor has worked within the last three (3) years. <br />B. Evidence, in form and substance satisfactory to the City, the vendor possesses a going concern <br />and the managerial and financial capabilities to perform all phases of the work called for in the <br />11/12/0414:08 <br />C:\W INDOWS\TEMPWORCSE- I.DOC
