Section 7. For the purpose of Section 6 above, it shall not be deemed practicabie to <br />distribute an overtime opportunity in strict accordance with the oveftime lists where: (1) the <br />City, in good faith, estimates that the opportunity consists of no more than one (1) hour of <br />overtime work per man required, or (2) the opportunity arises during an emergency. <br />Section 8. In distributing overtime opportunities, the City or its represenfiatives shall not <br />engage in a policy favoring an employee or employees, unless this Agreement requires certain <br />employees to work the overtime. <br />ARTICLE 11- LEAVE OF ABSENCE <br />Section 1. Military Leave: <br />(a) Bargaining unit members who are permanent public employees of the City, as <br />defined in Section 5903.01 of the Revised Code, and members of the Ohio organized militia, or <br />members of other reserve components of the armed forces of the United States, including the <br />Ohio National Guard, are entitled to leave af absence from their respective City positions <br />without loss of pay or benefits for the tirne they are performing service in the uniformed services <br />because of an executive order issued by the president of the United States, an act of Congress, <br />or because of an order to perform duty issued by the governor pursuant to section 5919.29 of <br />the Revised Code, for a period not to exceed one year. "Without loss of pay" means that the <br />City shall pay to any such employee, in accordance, to the extent practicable, with the City's <br />regular payment schedule and calculated on a bi-weekly salary basis, the difference between <br />the pay the employee would be receiving as a City employee had he not have been called to <br />active duty, and the pay he or she is receiving as a member of the Ohio organized mi(ifia or <br />other reserve components of the armed forces of the United States, including the Ohio National <br />13
