ARTICLE 14 PROMOTIONS. BIDDING. TRANSFERS AND JOB TRAINING <br />Section 1. Within ten (10) days of when a vacancy occurs within a job classification <br />covered by the terms of this Agreement, or a new job is created within the meaning of Article 18 <br />of this Agreement, the City shall post a notice of the opening for seven (7) consecutive calendar <br />days on bulletin boards within each department. If the City determines that it will not fill a vacant <br />position it will so notify the Union within ten (10) days of when the position became vacant The <br />notice shall contain the job classification, title, rate of pay, department and a brief job <br />description. Any employee may apply for any such opening posted by filing a written application <br />on forms provided by the City, with the appropriate Director on or before the last day of the <br />posting periad. Any application not timely filed need not be given consideration. <br />Whenever the City anticipates that a position within a classification that is covered by <br />this collective bargaining agreement is currently occupied will become open within thirty (30) <br />working days as a result of a retirement, termination, resignation or as a result of another job <br />posting and the City determines that the position will be retained or filled, it may be permitted to <br />post the position and classification for a period of seven (7) consecutive working days and <br />award the position. <br />Section 2. All timely applications will be reviewed by the City and the job shall be <br />awarded within five (5) working days to the most senior applicant who possess the skill and <br />ability to perform the job, except those employees moving to a lower rated classification or <br />moving laterally shall be awarded the job in preference to employees seeking a promotion. If no <br />employee who appiies has the necessary skill or ability, the City shall have the aufihority to hire <br />outside the bargaining unit. If the City chooses to test an employee, the objective portion of <br />testing a employee's skill and ability to operate equipment, sha(I be given in a fair and equitable <br />manner and will be given on equipment that is required to be used +n the job classification. <br />Effective June 1,1995 through the duration of this agreement, regular full-time Clerical and <br />Technical Unit personnel may bid on jobs in the Service Waste Water Unit providing no eligible <br />employee within that unit has bid on the job. Job postings for Service / Waste Water unit <br />positions will be posted at the bulletin board locations cited in Article 5. Employees awarded <br />19
